If you have seen my previous post you will know that somebody drove straight into the side of my car yesterday, anyway been trying to sort out the claim today and a courtesy car whilst mine is being repaired and just had a call saying that it looks like the idiot who hit me has only got third party insurance in which case it will cover the repair but nothing else! Now how the hell does that work, I always believed that if you opted for third party only it was your risk and not that of anyone else?

Utter nonsense.

You are the third party!

Have you tried speaking directly to the other driver's insurers directly? They would no doubt be delighted to put you in a replacement car if it stops you having to credit hire an expensive replacement.

That was my thoughts exactly Rob, I got on to the OPC who are dealing with it through there approved body shop but it is going through a claim company who have told the OPC this, so now have to wait till tomorrow to see what is going on, very strange.

Forgot to ask, what is "credit hire"?

It is Sytner drive who are dealing with the claim, I have just looked at anniesdad's company and they appear to offer the same service.

Credit hire is putting you in a replacement car at huge expense to the other guy's insurers but no initial cost to yourself.

People will be fighting over the opportunity of helping you as solicitors are paying £800 per case in the current market.yikes

Where there's blame there's a claim...

Phooey's advice is sound, PHer anniesdad has a good reputation on here.

Just be cautious about who is giving you advice and what you have to sign.

Thanks Rob, have just looked up Sytner Drive and that is exactly what they are but it was the OPC who put me on to them, I have signed nothing so if they say they can't do it tomorrow then I will either get onto my insurers direct or speak to anniesdad, but it appears that they are offering the same service as sytner but I stand to be corrected.

Careful now! If you accept the hire car and aren't cautious in how you accept it then you may be liable for the cost of the hire car in the event that the other party has a problem with insurance or their insurer refuses to pay up!
I've spent 2 years helping fight just this scenario even though it's pretty much entirely the other person's fault, (their car crashed into mine when mine was parked), but their insurer is arguing the total hire cost which is 3 times the cost of the damage, (car was not accepted when returned due to sub-standard repair). I'm only avoiding an automatic charge due to the fact that I requested and received, eventually, a letter from my insurers stating that providing I co-operate with them at all stages, I won' be liable for the charges and they'll foot the bill.

It's currently going through the courts as an insurance vs insurance test case :-|

On the plus side I had a 2010 987 Boxster for the best part of 3 weeks with 700 miles on it smile

Thanks for that, I will ask for confirmation but I suspect that is what they are trying to avoid judging by the phone call from OPC saying that I might not be covered for a courtesy car due to the insured being third party only. I await with interest today's outcome.

Ok just an update, apparently it is all sorted now and I got confirmation that I will not be liable for any costs whatsoever, apparently they take out a policy at there own expense that covers them for any costs in the event that they are unable to recover them from the other parties insurers. So hopefully all will be ok,fingers crossed just annoying that I will ave a repaired vehicle.

When the hire car is dropped off with you double check the paperwork as this does not sound right to me.

The credit hire agreement I had last year clearly stated that if the CH company was unable to recover the hire cost then I would be liable.

Also, take the inspection/walk around of the hire car on hand over very seriously - point out everything and get it put on the condition report. Really check interior trim (easy to miss).

No she clearly stated that they take out a policy to recover there costs in the event that they don't get the back from the insured, I will make sure it is in writing though before I sign anything. I wonder if a few people have been caught out and kicked up a fuss and that is why they are now taking out the policy.
