Hi guys.

I've got a strange problem in that I bought my car with a Autoprotect warranty (I have all the paperwork for it) and need to claim on it for my leaking radiator (£600 + fitting for a new one). I have contacted them and they would have no problems paying for it but the car doesn't exist on their system. The previous owner paid for the warranty via the Noble dealer when he bought it and I have contacted them regarding it. They also have the paperwork for the warranty and so it seems as though for whatever reason the paperwork never got sent or got lost between the dealer and autoprotect.
The dealer has had 2 weeks to put this right but i've still not got anywhere. The warranty only runs until the 10th May and so I feel like I'm running out of time.

My dilema is should I wait it out, perhaps another week or so and see what happens, pay for a new radiator myself before the 10th and then invoice the dealer/autoprotect for the cost and fitting or buy an uprated pace one and fit it myself and then invoice either for just the cost?

Or does anyone else have any other suggestions?

If the paperwork exists then the abscence of any record on their systems does not mean the contract is not genuine and enforceable. Their failure to keep records cannot deny you your rights. Its an insurance contract, thus the important date is the date on which your claim is lodged. As you've notified them of the claim within the contract period it does not matter if it expires subsequently.

I would get it sorted with dealer pronto! I should think that after the 10th May, your words will fall on deaf ears with the companys involved. I think that the dealers are not using auto protect anymore, but a new one called Customer protect, which may be the same, I don't know.

Defo pretty tricky getting them to cough up the dosh though!

I bought my car from a dealer , with the remainder of the previous owners warranty , plus the dealer added another year on top.

However , when i wanted to claim, the warranty company said it wasn't covered as the dealer hadn't paid the transfer fee of 25 quid. ( incidentally it was outside the cover as it was wiring ) and the dealer paid for half of it. .....better than nowt ..

However lesson learnt..

I would write to both the dealer , and the warranty co explaining you want to make a claim so you are not time barred.

At least if it goes smelly you have something to go to the small claims court / FSA with.

Do nothing is a sure fire way to pay for it yourself..

Deffo what he said.
Send all correspondence registered and signed for, that way you have proof of a trail of correspondence that the companies would have to explain in court if they try to deny that you made contact regarding a claim.
Make it clear that it is your intention to seek legal advice and compensation if the companies involved don't play ball.
You have a contract of warranty, it is up to the dealer / warranty company to sort this problem.

Cheers guys.

I've sent them both a letter recorded delivery now and I've confirmed with Autoprotect that they had logged my call to them on the 21st April about it as well.

Just sit and wait now I guess.
