Basically looking for advice on where I stand.

I sold a car to webuyanycar and we agreed a price and it was done I received a purchase invoice and I thought that was it.

They then emailed me saying they suspect the mileage has been tampered with so they need to do tests on the ECU. The tests came back showing random numbers and they said the mileage wasn’t correct based off that.

So I now took it up with the Audi dealership I bought it from which they took the vehicle in and done their own tests and have confirmed that the mileage is correct.

Now webuyanycar are refusing to pay even though they’ve taken the car out of my name and have my car. They said I can accept a new revised price which is £10,000 less than the original offer. If they truly believed the mileage was tampered with, why would they still want to buy the vehicle. Am I within my right to go to trading standards and want the original amount agreed for the vehicle?

Just looking for some advice here as stressed and need to vent.

If they won't accept Audi's findings I'd get the car back and sell it another way.

Not very helpful retrospectively but I would always pay the £30 for immediate payment if possible.The last car I sold them the money was in my bank account before I got home.

But they’ve taken the car out of my name after saying they don’t want it. Now have to wait 4 weeks to sell it.

Yeah I tried to do that but they can’t do it over a certain amount, or that’s the reason they gave anyway

I don't understand how have the Audi Dealership now done there own tests when WBAC have your car? And why would WBAC take it out of your name to add another keeper, all there stock purchases are just passed to trade so the V5 should still be in your name.

Possibly but the OP does not have to accept the revised offer and WBAC should return the vehicle.

As the vehicle manufacturer has confirmed the mileage is correct WBAC cannot renege on the original agreement by low-balling, if anything I would call this breach of contract.

I found myself in a similar situation with them, but not for the mileage.

I argued the point as I didn't want another owner on the car. I spoke with DVLA and they stated that me taking back the car will mean another owner, even though it's me. They (DVLA) advised I can write to them and plead my case. They will then issue the V5 back to me as if I had not sold to WBAC.

Luckily for me, WBAC stopped messing me around and the deal closed.

Depends on what the sale agreement said that the OP signed. I've never read one from them as I assume you've not either?

Not that simple with WBAC (and probably other similar services) I sold a car to them around 6 years ago and it was all fine but they do lay out terms and conditions which you have to sign saying that if they later inspect the car and find issues undisclosed they reserve the right to revise or cancel the deal.

Which would be all very well if they'd paid for the car but they haven't. And there will also a signed contract with T+Cs.

So I don't think banging the private sale no comebacks drum is going to suddenly make WBAC go OK fair enough here's our money.

WBAC do have terms in their contract that say they can come back if they find the car was mis-sold to them. Selling a lemon to them isn't quite as open and shut as it might seem.

Not saying this is the case here of course. OP I'd just take the car back and go to one of the other 'Buy Your Car' places. I've used We Want Any Car before and they paid more than WBAC

Exactly this.

Question: are they prepared to hand the car back to you if you don’t accept the £10k reduction? Changing the ownership back to your name shouldn’t be a problem, although I’m not sure that as a trade sale WBAC would have registered in their own business.

If you can get the car back that’s the route I’d be going as this looks like a potentially protracted hassle.

I wonder what Audi it was where they have offered £10k less....
Were the Audi dealer you bought it from and WBAC went to get it checked out not interested in buying it back?

If its really nice condition Audi I've previously sold a couple of Audis to WVC Consultants.

I heard a tale of a WBAC sales person who was irate with his area manager about holidays or something, decided to quit but before he did he used his last 2 days to push everything through as a grade 2 or 3 when most where grade 5 and mechanically knackered.

If only you could find one of those sales people.

In WBAC defence, they do get a good few ex taxis that have been clocked trying to sneak through.
It was easy when the bulk of them where Skoda Octavias and Seat Toledos, now the local taxis are a real mix, no common model to look out for.
