Advice needed!

Finding myself in a tricky spot!

Looking to free up some cash for a holiday and decide to trade our 2008 DB9 in for a Porsche Macan Turbo..

Agreed 27995k for the Aston against a ticket price of £27,995 for the Macan..

A straight swap, however I would take 17995 cashback and put 10k down on the Macan and finance the rest with Motion Finance..

Majority of money needed for a holiday..

Arrived at dealership 3rd July to do the deal only to be told the Macan was the Managers fathers car and still on finance so they couldnt give me cashback straight away, would take Aston give me 5k and drip feed the rest over the next week ( or thats what happened)

Usual story didnt check car very well.. looked at rear tyres ( Michelins) and didnt spot the Setula Race budgets on the front)

whilst fuelling car next door notice a number of tiny dents on rear passenger door skin.. Think oh well will book my dent guy

Dent guy checks car - not dents, runs in paint all four doors have been painted and not a great job

get quotes of around 3500 to paint both sides..

spot an oil leak found at last service at Porsche Portsmouth but no receipt for the work...

decide to reject Macan, garage turns round and starts to say they dont want the aston and they want me to by it back ( by now paid for my holiday and cannot buy it back!)

long story short they said they will pay the 10k back when they sell my Aston.. returned Macan to dealership on th 19th July....

desperately need 10k back as have bought another car and need to pay the deposit..DVLA receipt Aston sold to Motor trade..

Where do i stand?? I want my money back...

They are perfectly entitled to insist you take your car back. If you have spent the money then that’s your own tough st and your only option is to wait for them to sell it

all i can take from this is a 18k holiday!!!!!!!!!!!!!!!!!!!!!!

actually interesting predicament. If you reject a car is it automatically assumed a "part-ex" is returned. Are you, in rejecting the car, cancelling the deal or does the dealer still have to offer the PX.....if so what against??

OP i think you own an aston and a pricey holiday.

I guess there are a lot of Macans driving about with less than 10k equity in them.

Get a loan for the 18k, get the Aston back then sell elsewhere and settle the loan?

Morning!

First off the holiday was a lot kess, weve had. a ste couple of years and wanted a break , missus in nasty car accident and ive been unable to work since, now registered as her carer, all sorts of bad luck and thought be great to take the family (11 of us) away..

If the Macan was good id be driving it now, i really liked the car, i just felt i shouldn't hve to spend 5 grand plus on it immediately to put it right...

I suggested to the dealer he trade the Aston out and give me the balance, but they havent done this either..

My point of view is this, I sold the Aston for a reason, to free up some cash, but its the garage at fault for supplying me with a shoddy Macan, that wasnt as described, they told me its a nice example, completely up together ( they forgot to tell me about the oil leak clunky transmission and multcolour doors..

I appreciate i should have spotted it..

I cant buy it back i dont have the cash, I dont want it back either!

I don’t understand? If you needed 18k (and sorry about your wife), why didn’t you just get a loan unconnected to the car - keep the Aston and no Porsche problems?

I just thought id free up some cash that way...

It is a difficult one, I dont own the Aston anymore it was taken into the trade and i have the DVLA receipt ..

Again i dont feel like its my fault as had they have supplied me with a decent Macan id be driving it now..

citizens advice say the garage are in the wrong and its a restriction of rights as i have no control over whether the Aston is sold or traded, Id take less, just want it sorted..

Do you actually need that car? You’ve gone from an Aston which I assume was a toy to the Macan which was to free up money. Is it a case of suck it up and get the remaining money when the Aston is sold?

Consumer Rights Act 2015 said:

So it appears that the garage is entitled to return your Aston in exchange for the rejected Macan, in lieu of money.

Accepting the Aston back and putting it through Motorway or similar might be the best approach? Should get ~market value for it within 7-10 days I think.

As above I suggest you sell the Aston yourself as soon as possible. Not sure how committed you are to the other car you have bought but it would make sense to hold off on another purchase until you know exactly where you are. Slow down a bit.

Macan with a clunky transmission?

If that turned out to be the transfer box, and car has full Porsche history, Porsche have a bulletin that'll cover the replacement transfer box up to 8 years.

Just in case you end up in another Macan.
