What are my rights - buying used car from garage
Discussion
Hi all,
Bought a car three weeks ago from a local garage and I’ve already noticed an engine issue (lurching) and a screeching coming from the breaks. The car (mercedes GLA) was 11k - so obviously I’m not happy and have let the garage know its going back to them next week.
Now I just want to know what my rights are. I know from dealerships you have more rights than buying privately. But as this is a garage that occasionally sells cars so where does it sit on that range and what are my rights? I also part exchanged my old car which they gave me 3k for. Obviously, if they can’t find the fault or don’t give me confidence they’ve fixed it I’ll want to be able to ask for my money back..

There is no 'range' - you're covered by CRA which means that in the first 6 months the fault is assumed to be present at point of sale unless the dealer can prove otherwise. But it will really come down to how good the dealer is.
Depending on what the actual noise is, I wouldn't expect brake squeal to be considered a fault but the engine issue sounds like it is

Interesting re the cover under Consumer Rights. Do you think a lot of 2nd hand car dealers are aware of this?
I bought a 2nd hand car last week and the salesman was keen to tell me that their 90 day standard included warranty didn't cover much and kept pushing for me to pay £600 for a 'better' 1 year warranty.
I didn't go for it because I don't trust any 3rd party organizations to ever pay up if needed.
So! say the timing chain goes in the next 3 months, I could just return the car to the dealer and insist that they repair it under my Consumer Rights?
Cheers.

I think it would be tricky with a timing chain since it clearly wasn't broken when you drove away. But it depends on the cause I guess.
My climate control started playing up on a car I'd owned a couple of months. I did have extended warranty but they declined the claim because the cause was 'water ingress' to the control module. Dealer informed me that it would cost me £1,100 to replace the module.
I told them that if the car leaked, then it was leaking when they sold it to me unless they could prove otherwise - hence CRA meant they were paying.
They agreed without arguing (and I told them to fix the leak at the same time).
This was a main dealer though

If there is a genuine issue with it then they should fix it, whether worn brakes is negotiable might be a different issue.
In respect of having the dealer pay for it to be fixed or give me a refund.
The car is lurching and juddering at certain speeds. I know from experience that engine issues can be difficult to diagnose so the point i’m making is if they say they found no issue or that they don’t know how to solve it then am I entitled to ask for a blanket refund.
