Hi all,

I swapped my car a few weeks ago. Before swapping, I checked the car on Motorcheck. It came out clean, with no category. But now I am in a situation where I urgently need money and I decided to sell the car. First tried Motorway, but they rejected it saying that the car had been in an accident and had cat N. I thought that it was a mistake and decided to go to webuyanycar. Upon arrival, the guy asked if I was aware of the fact that the car had been in an accident and was category N. 2 different companies are saying the same things while MotorCheck showed a clear history.

A guy from webuyanycar told me that I should only use official HPI to check the cars and that all other websites like motorcheck do not always show the history of the car.

So the car cost me £11K, while webuyanycar can only offer £3,300 now due to its history. Motorcheck says that they do provide a guarantee of their data, but their T&Cs say they only guarantee that the data they get from MIAFTR will passed to me correctly. Meaning that If the data MIAFTR was wrong they are not liable.

Do you guys know where HPI gets its data from? Also MIAFTR?

And do I have any chance to get compensation from Motorcheck as they provided me with wrong data?

1) was this a private purchase?
2) check the fine print on the motorcheck service you used, unfortunately some of them have disclaimers that will leave you out of luck.

A Quick Look on Motorcheck seems like they use wording like ‘Our records do not show…” etc instead of ‘this car has not been cat N registered’. There’s quite a lengthy disclaimer that states it’s not guaranteed to be accurate

2) Yep, I do understand that they are very clever with the T&Cs, hence my question here. Maybe had a similar experience? How did it end?

Just in case your 'MIAFTR?' was a question -
MIB is the data controller for the Claims and Underwriting Exchange (CUE) and Motor Insurance Anti-Fraud Theft Register (MIAFTR) databases.

MIAFTR is a database containing records of written off and stolen vehicles, as defined by the Code of Practice for the Disposal of Motor Vehicle Salvage.

Is it possible that the vehicle had been involved in an accident, but not yet written off, when you did the check?

Yep, my question is if both official HPI and Motorcheck use the same source - MIAFTR?

I don't think that it was timing. The accident happened in October 2022. I acquired the car in Feb 2024. Doubt that it would take 15 months to update the database.

There have been many occasions when HPI & other checks don't show the car as a CAT but yet VCheck does which is why it's the only one I use.

I can't tell you how it works but I've not had a failure yet unlike hpi.

Also, 13/14 months for a claim (if the owner of the vehicle refused to settle quickly) is not unheard of.

Use both as Vcheck has missed some cars that are showing on HPI.

I had a quick read of their T&Cs, which I won’t comment on, but I won’t be using them…

Anyhow, I think the thing which you will have to show is that an HPI/competitor check performed at the same time as theirs would have shown an issue but that their check didn’t flag it.

Someone might know if this would work, but could do another check on the car using another company and they tell you when the data was added to the MIAFTR database? If it’s before you did your original check, then you might have a case
