I have unwittingly purchased a stolen vehicle (from a dealer). It was discovered by an ITP and we informed the police who have seized. Has anyone dealt with this and recovered the purchase amount from the dealer before? I understand the dealer/previous owner never had the right to sell the vehicle in the first place so wouldn’t that make the contract null and void or something?

Just hand the car back and request your money back, you have up to 30 days to do that I believe.

Established it was stolen a few months after purchase- also, police now have the vehicle as it’s going back to the insurers (who legally own as they settled original owner when it was stolen originally).

When you say dealer do you mean a dealer with a large premises, lots of stock and been there for years? Or do you mean dealer, as in huge guy with shaved head, neck as thick as a tree trunk and a large amount of Dobermans in tow?

The answer will make a difference to the outcome.

Dealer as in stock/website/reviews/lot/warranty arrangements (companies house) etc

I've no idea what an ITP is in this context. Sounds fascinating, how many times has the car been stolen and by whom?

If you bought it from a bona fide motor trader who is a real business with business premises etc you are pretty much covered, although it might be a painfully slow process.

If you bought it from a used car lot, who may have already ceased trading/ changed the company name or from someone who is going to pretend to be a private individual, your in for a VERY tough time.

Take proper legal advice ASAP.

The dealer selling you the car should be able to prove that they did the appropriate HPI checks on the car etc.

Even if they did the appropriate HPI checks it doesn't obviate them of the obligations.

Yikes. If its a real dealer than you have something to come back on. Sucks OP, hope you can get a decent outcome from this.

i always do my own hpi regardless of the dealer 'hpi'

Hi all- sorry for slow response (newbie so limited to 5 posts inn24hrs).

So, I ran an HPI check. Didn’t flag as cloned

I am discussing with legal expenses via insurance policy but they are slow - as I am discussing I don’t want to divulge too much at this stage.

I was interested if anyone else had had success in a similar situation as the citizens advice website suggests I should recover the lot but I have limited confidence

I would also discuss with Citizens Advice.

Pretty rough situation to be in, hope it all works out for you.
