Anyone got any experience of returning a vehicle / cancelling a contract on the basis that the vehicle does not do what they said it would ? Our company van does barely 50 miles in hilly West Dorset and we can no longer use it for the purpose we took it on - namely delivering e-bikes to purchasers and hirers. It is now having a real impact on our ability to perform our job. Obviously there are no rapid charging posts either (as promised!). What should we go for - mis-sold by dealer or not fit for purpose ? Banque RCI have already told us they are not going to take the vehicle back (all we want to do is to switch into a diesel NISSAN vehicle) and referred us to the Financial Ombudsman. Any similar experiences / advice ?

I wouldn't rate your chances to be honest - I am having enough trouble with them, having sent in a cheque for payment which they cashed but didn't credit to my account. Not even asking for a favour, just for them to actually, er, do their job, but can't make headway and my cash has vanished into a black hole.

I suspect the dealer is a better bet, if they will cut you some sort of deal, the dealer will have a lot more clout in getting something sorted.

Had a call from Nissan Chairman's office...trying very hard to help out..but it's not their fault....so I suggested it was the advertising brochure's fault...claiming up to 90 miles on a charge...maybe in London / flat areas with perfect conditions...anyway long an dshort of it is that Nissan customer care is not remotely bothered...my fault for not taking it for longer test drive. So I can pursue the dealer for mis-selling..any advice ?

This is what it says about range on the website just now

...a range of up to 106 miles per full charge (assuming 95% efficiency). Actual consumption and range may vary due to driving style, road condition, air conditioning and other factors outside our control....

there is no guarantee of the miles per charge

I agree that you should have taken a demo vehicle for a couple of days to see how it performed in use

Unless the dealer stated in writing that the vehicle would do a certain miles / charge and that there were to be rapid chargers in x locations by y date, then I am afraid it is down to you

Try to keep the dealer on side, they may do you a good deal to swap out into a diesel. Unlikely, but more likely if they are on your side than if you have peed them off - for instance by accussing them of mis selling

I have one and there is no way you will ever get 106 miles unless you put it on a trailer best I have seen from mine is 89 miles and that's driving in Brighton in 20 mph zones and not using any heater etc

Agree it is down to me being gullible and falling for it. What is harder to take is their unwillingness to help in any way...
