I bought tyres from this guy from the classified section, he tricked me in to sending the money as a gift and sent me 2 damaged tyres that are of no use. I've tried to emails but no response.
So just a warning to others "DO NOT BUY FROM THIS GUY"!!

No offence but buying something from someone you don't know or have never met over the internet then using paypal is a good option. Sending a "gift" is just plain stupid in my opinion... you may as well just send the cash in an envelope.

I do feel for you though frown

It was through paypay, but as a gift. I never knew that you have no comebacks if its sent as a gift. I thought paypay was safe no matter what.

You probably know now but a gift means that the seller doesn't pay the paypal commission so no come back.

Maybe im being harsh but paying for stuff like tyres from a bloke on the internet is asking for trouble.

you still bought from a business though? (unless he trades as a private individual, in which case he will be in trouble)

in that case you are covered. just threaten trading standards.

It doesn't matter how you paid him, as long as you have proof of payment, twhich paypal gives you.

the way I see it, is if he is registered as a business, then advise him you will be contacting trading standards as the good were not up to spec. give him the chance sort it out etc...
if he idn't, then threaten him with shopping him. I bet he won't be paying tax on his income, so he'll be in a lot more bother.

this is bull. this is only comeback through paypal. who said that was the only comeback? it's like you guys have taken the ebay terms as national law.

1) Please don't name and shame on PH. I've left this up as there's some useful advice in it.

2) Report the ad if it's in PH classifieds. It might not get it pulled immediately (There are two sides to every story) but it's a start.

How far does N+S extend? Could you, for example, not mention the person or link to his site but say you wouldn't buy from someone who has a page about .......?

What he's done by sending the money through PayPal as a personal gift, though, is effectively signing a contract saying that the money is being sent in relation to no goods, purchase or service whatsoever. This makes it bloody hard work to get it back because the tyres are crap!

This is why I never send money by PayPal as a gift unless I know the recipient personally.. It's simple to add the PayPal fees of 3.4% + 20p to the amount you're sending so that the seller gets the right amount, and I consider that a more than worthwhile insurance policy. The reason these fees do not apply to gift transactions is because PayPal expend precisely no time chasing up problems with such transactions.

That's the thing with all N&S, there are two sides to the story and while it's perfectly possible that the OP's is correct Haymarket and PH don't want to get embroiled in an expensive legal fight trying to establish what has actually happened.

Has the OP reported the ad?
