That was my first thought, but what is the offence?

Zero chance of successful prosecution.

The offence is having an unrestrained passenger, it's the passenger that would cop it though. They wouldn't be allowed to continue the journey without a seat if stopped.

When I did my Cat C training there were three of us in there and only two seats plus bunk. So maybe you'll be ok?

Yet one is allowed to sleep as the other drives, leaving an empty passenger seat?

Anyway, I've spoken to the DVSA today who said get another seat/belt fitted and then apply to the DVLA to change it to 3 seats instead of 2 so hopefully I can inform the insurance and that's job done.

It's ruled by the number of seat belts fitted .
Also many countries frown on people sleeping in bunks whilst the vehicle is in motion .
As many countries insist on seat belts being used it really is a bit of a no brainer.
I used to do lots of double manned work and I personally never used the bunk in a moving vehicle but many of my workmates did ..

You'd need to fit additional seats/belts and get it approved, can be done like this company with extra seats above the cab!

I haven’t spoken to them in over a year, so things may have changed, but the last time I did..

They can use the existing bunk and fit up to four seat backs on the bulkhead. All available with 3 point seat belts.

All their equipment has been the approved.
