I have an employee who has not got a digi tacho card come through yet. We/He has sent off for one today but we have a job coming up in the next week or so that requires us to hire in a truck with a digi tacho.

I am pretty sure we cant get him to drive it but I am looking for clarification.

The use does not fall under any of the exclusions or derogations.

Is there something I am missing, could he do a manual entry ?

He could if he had lost his card or if it had developed a fault. The question here is: can a digi tacho vehicle be used by a driver who hasn't yet received a digi card?

If he doesn't yet have a card he cannot drive it, if he'd lost it or damaged it as GC8 said then he can drive it while awaiting a replacement

If its been issued and you are sure, then he can 'lose' it and make a manual entry. He will need to apply for a replacement in order to cover his arse, of course.

He can't drive it until his card arrives. Losing an initial card before it arrives would be far to clumsy to be possible.

I acknowledge that it is Plan B at best.

But he won't know when it's been issued until it arrives.

I guess you could phone every day to find out, bit tedious though.

I wouldn't be risking it, if caught both the driver and OP would be royally ass raped by DVSA and TC

Oh, I am not letting him drive it until the card arrives, I don't need the hassle or stress.
