Hypothetical question which came up at work today.

If under guidance of a banksman when reversing, you have a collision. Who is liable? Driver or banksman or shared responsibility.

Driver. Ultimately he's in charge. Banksman or not, if you can't see and you're not sure, get out and look for yourself.

The driver will always be blamed, even in a a situation where he was not able to see for himself.

Travis Perkins no longer allow their staff to direct vehicles off of their property after a claim went against them, I don't know any more than that though.

agreed.
the world famous, "drivers responsibility."

everybody wants their load delivered as quickly and cheaply as possible, and some are prepared to cut corners, and sometimes expect the driver to do the same, but at the end of the day, if it goes belly up somewhere, you are always quoted with, "drivers responsibility."

I was being banked into the car-park under the new Tesco in Yate last year delivering access plant, by the site banksman. Plant hit the wooden fascia, he took full responsibility they never even took my name or reg, no damage to plant. Brings a smile to my face every time i go past and see the odd inserts they replaced it with.

Saw a guy getting guided off a CalMac ferry to Arran with a mobile home( obviously new) 3 guys watching all missed the front corner hitting the mezz deck. BIG dent in the thing, all 3 disappeared. Guess who ended up with the blame?
Once asked a guy to watch me back into a site. He did just that. Stood looking.....
Sometimes youre better off without help.

The only time I've ever hit anything whilst reversing the truck was when my dad was guiding me !!

I was on a ferry to Le Mans last year ( well ok the ferry didnt go to lm) and they were turning everything around on the lorry deck, guy with a double cab pick up and a big ( 3 axle) caravan in front of us being guided by the ferry staff. total bd to turn around requiring multiple shunting backwards and forwards..

they managed to guide him into taking one of the fire detectors off the side of the ferry. que everything having to stop and the captain coming down to check it was safe for the ferry to still sail !!!

The Ferry co took responsibility though... so much so they insisted un hitching our car trailer from the camper and manually turning it although that may have been as it would have taken ages to shunt it, huge turning circle on the camper even without a 20 ft trailer behind it !!
