What about the impact on good zoos? Imprisonment is imprisonment, whether it's a bare concrete cell or a massive complex with trees and ropes, tyre swings, 5 meals a day and all the internet chimp porn they can handle, if it becomes case law then all zoos may have to release their chimps (and maybe bonobos).What would then happen to the animals? They can't go to private owners (that would be slavery); I can only imagine they would have to be released into the wild - any that were bred in captivity (probably many now in western zoos) wouldn't have a very high chance of survival.

But that's the thing, it doesn't matter if it's a good, comfortable zoo or not, if it were to become case law (I'm not sure if it works the same in the US though) then they (all zoos) are falsely imprisoning legal persons. They wouldn't be OK, they would potentially all be at risk. In the UK, AFAIAA, case law serves as a common guideline for judges trying any future cases.
People get sectioned if they cannot work in society. I would imagine sentient creatures who have no idea of how human society works and/or pose a danger to the lives of others would be the same. The question would simply be over the quality of where they are kept.xRIEx said:
