Advice about a neighbours dog

As a dog owner myself I am finding what to difficult,

Basically I live in a flat, 1st floor, my neighbour above has a dog also, and it's pretty much left at home on it's own every evening, which is none of my business, except it barks, and howls the entire time until the owner comes back, which I can hear, clearly and it's getting VERY frustrating. Coupled to the fact my fiancee is expecting in January I don't want it howling every night as we try to put the little one down

I've spoken to my neighbour about it, and she's rather dim, saying that she will try and sort it out, how I have no idea but it's not got any better, the dog warden has been to her in the past, unsurprising as you can hear the dog from the pavement outside

Any other ideas?

Talk to the dog warden and get them around again. Also consider Environmental Health (subject to some of the answers below\0

Otherwise, what is the set up of your flats, large block/small block? Rented? Owner occupied?

The leases for the flats are very likely to contain a covenant against causing a nuisance and a howling/barking dog is a nuisance (there is often a covenant against keeping dogs in flat leases so she might be in breach of her lease anyway).

If she rents then push her landlord to deal with this. If there is a management company talk to them.

If you confirm the set up re the flats I'll advise further about who best to pursue.

Its a small block of 6, all are privately owned except from one which is council owned as far as i am aware

The neighbour in question owns her flat, we all get on reasonably well, and i dont want there to be any confrontations which may lead to awkwardness in future, but its getting beyond a joke, every night after work from around 5-8,9 10 sometimes even 11PM the dog is constantly howling

Its been like this since she got the dog but of late its really beginning to grate me

Given that you've already had a chat with her, I'd have another "chat", saying that you don't want any problems but that it's becoming a real problem and that you will need to take further action. She may think that the problem is resolved?

Our last neighbours had a dog that they let bark in the garden at every bloody hour of the night, he was quite horrified when I mentioned it was a nuisance to us...rolleyes Sometimes people do need to have things pointed out to them clearly!

Is there a management committee? Who owns the freehold? Have you looked at your own lease to see if there is any restriction on dog ownership, often in flat leases dogs are prohibited - you could point this out to her (edited to add..hmm maybe not as you also have a dog!)

The more nuclear solution is to go to the dog warden and/or environmental health, this will of course then be recorded and will need to be disclosed to any potential buyer.

Good luck with the babe, this really does give you a reason to go to her and be fairly robust about this.

Offer to help and support her whilst she tries to solve the issue but warn her if she doesn't accept or try and sort it you will make it official re: complaints.
