Help needed on puppy deposit

Hi all,

We’ve paid a deposit in a puppy and the kids are very excited - we first saw the pups 4 weeks ago and then two weeks ago where we paid a deposit in a specific pup with a signed receipt. we’ve been waiting 2 weeks and are due to collect next week. Got a text tonight from breeder saying they’ changed their mind and want to keep him.

We desperately want him! Where do we stand legallly? The have offered to return deposit but we want him.

You want to legally force someone to sell you a puppy?

Move on, find another dog. They’re (mostly) all very cute

Kids have set their heart on him. He’s a GSD and this is the sixth breeder we’ve been to, all the others were terrible and this was the first one we gelled with.

We’ve also selected this litter due to timing with our lifestyle and already having a puppy - we turned down two other litters as this pup seemed perfect. Completely messes us up.

Still keen to know our legal position.

I'm no expert but believe that a deposit evidences a contract. I'd ask a solicitor where you stand. The other party are in breach and you have incurred a loss.

It would be easier to move on though. Lots of dogs in shelters need a good home like yours. You could take the family on a visit.

Your first paragraph is my thinking but I need the help of someone in the know!

Our children are young, my wife is Veterinary and has seen a lot of problem dogs at work due to poor socialisation; must be a puppy under 9weeks old!

You'll change your mind if you go to a shelter despite your wife's job.

Best place to select a dog is a shelter. You see them all. All shapes and sizes are there. My last rescue dog had had 4 owners within his first 18 months and all for genuine reasons.

He was an awesome dog, a proper clown of a border collie. Everybody loved him, such a mutt. He was 17 when I put him to rest.

Defo a shelter for me next time.

Be open minded to the possibilities.

It’s an absolute no.

Wife started off her profession in a rehoming centre; has done a lot of behavioural work and would never rehome to a young family - far too many unknowns; socialisation is crucial!

I've never bought from a breeder and probably never would, but if they're the type to renege on a business arrangement, I don't think I'd want a puppy from them anyway.

Move on.

By the to,e you’ve been through a legal wrangle, even if you win, the dog will be a year old minimum

Of you genuinely believe that (and I think you're being absurd), then you need to move on. This won't be resolved to your liking before this dog is 9 weeks old.

If I was the breeder and had seen this thread I wouldn't sell the fog to the OP anyway.

Sounds far too arrogant to have a dog, any issues and he'll always be the expert.

Must be a puppy, must be less than 9 weeks old, can't be a rescue.

If your wife really is a vet I'd question if she actually knows anything about dogs, because it sounds unlikely

When you say your wife ‘is veterinary’ I presume she’s not an actual vet? Because they love rescue dogs IME.

That aside, trying to force a breeder legally to sell you a dog is one of the dumbest things I’ve ever heard.

Just go to a shelter.

Here's my tuppence on the subject. Spend it well.

Firstly, I'll kick off with admitting that I don't know what 'due to timing with outlet lifestyle' means.

But, sometimes things don't work out. We cant always have what we want, no matter how much we want 'it'. You could try having a nice, calm polite conversation with the breeder and telling them about your kids expectations etc. Maybe you already have? Maybe the breeder has spoken to you/met you and decided afterwards, that actually they dont like the look of you, and wont entrust you with the puppy. Who knows?

Probably best for everyone involved to move on, and find another. Forget about dragging them through the courts for the sake of a puppy you want.

The OP mentioned getting a dog, plus their concern that unless they get it earlier than is normally reccomended they wouldnt be able to socialise it with their children.

I have no idea if said kids are teenagers or crawling toddlers - its a valid question on a public forum, unlike your pointless interjection.

Perhaps the breeder has concerns.... who knows.
