I have recently noticed a bird nest in my eves, house martins at a guess.

At first it did not bother me, but bird mess is now out of control, all over windows, cars and other parts of my property!

I obviously wish to remove but not sure of the legality. Where do I stand, and if it can be removed would an organisation such as RSPCB be required?

Is it like a mud cup where the eves meet the wall or actually inside the eves? House Martins make the cups. They'll be gone soon and it's also illegal to disturb any nesting birds but you can knock them down when they have left in late summer. You should feel special, I know they make a mess but they are very choosy where they live biggrin

If it's in the eves and making a racket with loads of poo going away from the house it will be starlings - again, all over in the next couple of weeks.

Illegal to intentionally destroy nest when in use. Move where your car's parked or stick a tarp over it for now - they'll fledge in a few weeks and then as mentioned you can knock it down once vacant.

Ideally, put up nest cups round the other side of the building where you don't mind them nesting, should hopefully encourage them not to do the same next year.
