So, I have a question for anyone that might know what to do...

I bought an apartment around Christmas time just gone. My flat number is 14 and the best parking spot in the carpark is number '14'. I, of course, thought this a massive bonus. However, before I bought the flat - the developer did explain that all parking spaces had been swapped so that they did not correspond with the flat numbers... this was for security and often done (I'd never come across it). My parking spot is therefore number '9'. A spot that is not covered and generally, not as good. I said to the developer; please try to organise an undercover spot; no matter the number; he said he'd 'look into it'. The sale did not depend on this, in truth.

Anyway, fast forward to sale time; I get the gubbins through from the land registry highlighting my assigned spot as number '14'. GREAT! I thought - the developer had stuck to his word and got me the number 14 spot that I wanted.

So, I start to park there - and then get into a dispute with my neighbours who are told that it's there space (whereas I have bought my place - they rent their flat from the developer himself) - anyway; he now says that there's a mistake and someone slipped up - that the land registry should show my space assigned, as number 9 and the fact it shows 14 is wrong.

From what I can gather - he's given my neighbours correspodning number parking place to someone else, so they've been told to use 14 (the one I believe to be mine) and as he's assigned 14 to them, he's just given me 9.

Now, if there's a genuine mixup - i'm happy to just bite the bullet and live with the space he says is mine - however, if he's just after an easy life and has simply not bothered to do these space swaps properly (legally) then I can rightfully claim the spot I want, right??

I've been in touch with my solicitor and he says that without digging deeper / and the fact that parking spot 14 was submitted to land registry with my sale - and not been sent back / disputed so far - the developer has probaly sold flats to people who requested specfic spots and as result, it's got messy and he's not bothered doing it through the proper channels.

Now, I can pay my solictor to run around and check up on this stuff - but is there an easy way that I can see a conclusive list / record from the land registry showing which space they have on record as belonging to who - without forking out??

Yes, do a search on the Land Registry’s web site for the developer’s rented flat, and see what parking space corresponds to that flat.

As above, or even try searching on the parking space (though I think 25m resolution is as good as it gets if you use the LR's map search, so may be difficult to isolate an individual space). Costs about £4 to get the title details IIRC, another £4 to get the title plan.

Hi thanks for the advice - I've done the seacrhes and downloaded the PDF's but it does not mention parking spot allocation on any of the PDF's I've downloaded for his flat... it should, by my thinking so I'm unsure why that is - and what options I now have except the official route - through solicitors.

Ask the solicitor you bought the property through for a copy of the title plan, and details of which parking space is yours. If the seller provided a plan showing the space marked 14, I don't think he's got a leg to stand on. But I suspect more likely there's no plan showing which space is yours and the number 14 has simply been carried through from the flat number. In which case, it might well be a mistake which can be rectified, meaning you'll get space number 9. The one you were told you would get...

Thanks for the advice guys.. food for thought. The plans clearly state 14 and my gut says he's given places out willy nilly and hopes I won;t follow this up.

As its a flat the parking space may be held on another lease and under another Land REgistry title number....The title to the flat should detail the parking space lease if this is the case..

Agreed, I've emailed my solicitor to put an end to it so all will be well.. just hoped that I could avoid the solicitor route but better safe than sorry.
