Housing question: Can anyone help? Solicitors ideally!!
Discussion
To compound further woes, can anyone help with a problem that my parents have?
To cut a very long story short, the boiler in the Charles Church house they live in has let go.
In spectacular fashion.
So far this week, the plumber has been in 5 times, and replaced virtually every part that is replacable, so far to no avail.
Additionally, it turns out that 6 other houses on the same development have had the same issues, one plumber has stated that the boilers are not fit for purpose.
To further add to the woes, the boiler company went into administrtion last october, so there is no come back from them.
Could anyone offer any (i know im asking for trouble here) any useful advice?
Would such things be covered by the NHBC?
We have spoken to Charles Church, who seem unwilling to do anything, claiming that the elapsed time means they are not liable.
Any help greatly appreciated.
PS, to those that know me, no i didnt attempt to fix it myself, but thanks for the concern!!!

I was just trying to find my pink tutu!
Hmm by my fingers that makes the boiler 5 years old? I think you're in difficulty with this one.
The logic is likely to be that any inherent defect would have shown itself in a shorter period of time so it is unlikely that the boiler itself has an inherent defect.
You'd then be down to whether five years is a reasonable lifespan for a boiler - I know very little about this stuff but I'd have thought that it probably isn't a reasonable lifespan but trying to prove that is likely to be problematic.
Do your parents have any legal expenses cover on their household policies? If so they should be able to get legal advice via that and may even get funding to bring a claim. Try this first, also try any packaged bank accounts that they might have.
It may well be worth all of the householders clubbing together to get an opinion from a decent plumbing engineer on what the issues are to see if its worth taking it further and then litigating as a group.
Even better would be if any of the householders have legal expenses insurance to fund a claim, the rest could sit by and wait for the result of that one.
IMV the developer is liabable for any breach that can be proved as they supplied the boiler as part of the house sale. It's their problem if the supplier has gone bust.
Good luck. I've got a bit more cash to get over to you will drop you an email in the next day or so.....

I wouldn't expect ford to, no. Ironically, kia do offer 5 years- being realistic a boiler has far less consumables than a car though. It's been services by an approved technician in line with manufacturers schedule. The fact is that 7 or so have all failed on the same development, within 8 weeks of each other- each time the plumber has said that it looks like the kit in question looks like it's been made up from left over parts.
The boiler also let go 3 years ago when the folks were in France causing just over 10k of damage to the house.
Plumber there again now, still can't repair.
Looks like being a cold weekend for the parents!
Ps, thanks for the input piglet- much appreciated
5 years doesn't seem like a reasonable amount of time for a boiler to last. SOGA might apply as goods have to be of 'merchantable quality' and clearly these boilers are not. Irrespective of the warranty period offered by the manufacturer/house builder your parents may still be able to claim. Our old boiler was ~20 years old before we had to replace it as it was about to kill the wifey and I.
And £5k for a replacement...? Was he wearing a mask and riding a horse at the time?

NHBC cover is only for major defects for years 3 to 10, and builder is responsible for all defects in years 1 and 2 only. So no comeback on anyone I'm afraid, just like any other expensive item that is out of warranty. <snip>

If the plumber has replaced every part to no avail maybe it's time to try a plumber that knows what he's doing?
Agree with Worcester Bosch comment.
Find the equivalent, and fit a new one.
It's a single days work for a good plumber, two days at most.
Even with a big, expensive boiler at £1k, you shouldn't be paying anywhere near as much as £500 to swap a boiler.
It's a simple, cheap, and easy job.
£5k is about £4k over-priced, unless it's something big and/or funky.
Are we talking system boiler, or combi boiler?
Fitted in an awkward place? Hard to get to?
Up to 10 or 12 rads in the system?
If you really want to salvage the old one, do a British Gas fixed fee callout. £165~~ fixed price repair, parts and labour, and it's guaranteed for a year.

Have the boilers been regularly serviced?
If not I see a get out there.
(£5k for a boiler seems steep by the way)
I have been quoted £2200 for a quality boiler installation, including running larger gas pipe and removing all the old system junk. 5k must be a mega system. If not I see a get out there.

I've just had a (gas fired) Worcester Bosch Combi boiler fitted last year (6 bedroomed house) and the total bill with lots of extra plumbing was under 2k.....
Regarding your OP, I think they probably are shafted unfortunately......but look on the bright side, they have had nearly five years use out of it......
Where's Ferg when you need him?....
