I'm currently living in a 2 bed flat and am currently wishing to leave. My contract for 12 months has come to an end and now on a Statutory Periodic Tenancy which entitles me to a month notice to leave the property.

Now, my flatmate isn't leaving the property and is happy to carry on as such. I've given my notice to the landlord about this and he says that i cannot give my month notice until there is a replacement for me in the flat (well he says that, but was told that from Gascoine Pees) so what are my rights? Is it a case of saying, i've given my months notice, you deal with it, or what the landlord is saying is correct?

I will be meeting with the landlord and GP on Friday lunchtime and would like to go with some info that says X,Y and Z as i think i am right.

What does your contract say?

If it is solely for you, then leave at your leisure.

If its a joint tenancy with your flatmate, either you find someone to replace you, or he gets to move as well.
