Advice Please regarding neighbours lift
Discussion
Im after some advice please on where we stand.
So , we live in a semi detached house. We purchased our property years ago. The adjoining house is owned by the housing association.
8 months ago we had new neighbours, recently they had a full ramp installed which intrudes on our land.
Then! I get home from work today and they have had a lift installed on our shared wall which backs into our living room ! Every time the lift moves it vibrates through our house as well as we can hear the lift in every room !
Anyone know where we stand with this ? This is not right.
Thanks

I think that you should first raise your concerns with the housing association to let them know of the impact that it is having on your property and the possibility of damage if it vibrates throughout the house.
Depending on their response, then I would be seeking legal advice as to where you stand.
Does your house insurance have a legal helpline to call for advice and/or legal cover to peruse any case should that become necessary? If so give them a call as well.

Is it actually attached to the wall or just close to it?
My dad used to be involved in disabled facilities grants, including installing through floor lifts, apparently they normally just attach to the floor rather than vertical walls.
Party wall act I think only applies if it’s physically attached to the wall.

I assumed “on our shared wall” meant fixed to. But, I see your interpretation and agree, party wall of it is fixed. I also agree the housing association should be involved. I’m sure/hope they will come to a reasonable solution. Thankyou for.your replies ! Much appreciated. So earlier I went around there and complained to them about the noise and vibrations ! I also complained to the installers also!
I took a photo of the lift , I would say its an inch off the wall ! Bolts at the bottom! Thing is it must be bolted to the wall upstairs or if not the joists in the ceiling which is joint to the wall !
Checked our housing insurance and legal assistance is not included in our policy ! Typical !
I cant believe the housing association can move such numptys into next door which affects our lives so much!
The 16yo son is an absolute plonker , punches holes through walls and all sorts. Iv brushed such instances off but not now after this shambles !

If the HA don’t play ball, then the only option will be to seek legal advice through a solicitor.I took a photo of the lift , I would say its an inch off the wall ! Bolts at the bottom! Thing is it must be bolted to the wall upstairs or if not the joists in the ceiling which is joint to the wall !

Sorry for being thick but the wall you refer to - is it the dividing wall between the two 'halves' of the semi detached house?
As for them being numpites, well to me it sounds more a case of poor installers of the ramp and of the lift to me whoa re at fault.
The neighbours can't help being disabled and seemingly in genuine need of the adaptations. Its just a shame that it's affecting your life through poor planning and installation.
Hopefully you can get it sorted

Yes its the dividing wall (shared) .
They got thrown out of their last house because of complaints, their previous neighbours rang the police on them numerous times because the son having his mental breakouts. They are nothing but numpties. Its shocking being thrown into this situation.

I’d be getting onto the housing association first thing and putting everything in writing. The ramp actually intruding onto your land sounds like a separate issue in itself, but a lift being fixed to/against a shared wall and causing vibration and noise throughout your house surely needs looking at properly.
I’d also start keeping a record of when the lift is being used, how bad the vibration/noise is, maybe even some videos if you can capture it. I wouldn’t get into an argument with the neighbours as presumably they need the adaptations for a genuine reason and may not have had much say in how they were installed, but equally you shouldn’t have to accept your own house being affected like that.
I’d be asking the housing association who authorised the work, whether a noise/vibration assessment was done, whether any party wall/planning issues were considered and, most importantly, what they intend to do about it.
I’d be pretty unhappy if I came home and found all that had been done without anyone even mentioning it to me.
One other point - I guess sharing a semi that has half ownership with the HA is a bit like living near a motorway and complaining about the noise - it would be a fair assumption to say you'll be more likely to encounter this type of neighbour than if it were a private ownership. I'd be looking to move if possible.

They are called platform lifts. They raise on a hydraulic ram which is powered and lower by gravity and a bleed valve.
What is is you can hear ? The pump or the lift moving ? There should be close to nil lift moving noise. If it is thd power pack then where / how is it mounted. If on the wall that may well pass vibration but should also be relatively simple to resolve.

I have sympathy for you OP but did you just walk in the house and start taking pictures? If I had been working in there I would have launched you and your phone out the door.
Well i would of launched you through the wall ! Of course I asked for permission to take photos ! Thankfully I did as we now have proof of what is going on ! Gassing Station | Homes, Gardens and DIY | Top of Page | What's New | My Stuff
