Hello, I've just had a Map modification order through the post. It is asking for public path across land that didn't have such paths on it on record.

1) What type of solicitor is best placed for this? I live semi-rural
2) My guess is they'll try to use 20 year common use rule. Has anyone gone against this before

Having had folk try to claim that a permissive path had turned into one with statutory rights, it's an area I know a little about.

How has the DMMO application come about? A proposal from the LA, or a claim of pre-existing historic rights?
There are ways to deal with 20 year claims but I wouldn't want to openly state them as it might provide ideas for a workaround.

Have you done anything recently to show that a permissive or historic route has been opposed/contested?

A known person in the village posted the application to us but I believe they would have sent another to the council with whatever proof they have
