i think this is the right sub forum, as we looking at potential legal action.
I live on a fairly new estate, around 10 years old.
its split into 3 sections, based on build order.
each section has its own management company. to look after the communal areas (there's lots of woodland on the estate)
here's the issue, we don't own our front garden. its made up of grass and privet hedges with sone other plants by the house. it is supposed to be tended to by them.
we've not seen a gardener this year, with the obvious result of needing a machete to get to our front door now. and the grass is gone in place of weeds.
we used to be pretty well tended too, probably every 2 weeks however this has slowly gone down to nothing. yet our bill has gone up again this year .
i have absolutely no understanding of how this system works, as it seem totally backwards to me. if it was my front garden it would be tended too and kept tidy.
is it possible to take action against them to either make them provide the service we pay for or to replace them with a more competent company.
were defiantly not the only ones complaining there are quite a few residents that i think could be organised against them.
any advise would be welcomed.

More info needed about the management company. Is it a RMC with actively involved residents or a tame outfit tied in to the freeholder?

my understanding is there aren't any residents representatives and were not share holders of this one, one section of the estate are shareholders of there own management company.

We were supposed to pay £200 per year for maintenance of the communal areas on our development when we moved here in 2006. Reality was they never came,so in the end we all stopped paying. Next door neighbour tried to sell his house and found that there was some sort of restriction placed on it by said maintenance company. When neighbours solicitors checked into it, they discovered that maintenance company had gone to the wall in 2007. It cost them a couple of grand to have restriction removed.

I'm a shareholder in the RMC where I live. The RMC appoints a company to provide estate/block management services.
So we have the power to get rid of them if we are unhappy with their performance.
Fortunately we have very knowledgeable elected directors who keep the service company under close scrutiny.

They will have contracted with someone to cut the grass trim the bushes etc. Looks like they are not ensuring it is done.
If you don't have a RMC for your section of the estate you need to try to find out who appointed emrc. Knowing where to exert pressure is key.

yep this is something they have been doing, as some friends of ours moved off the estate last year and faced the same issue. although they weren't in out section and the company way still inexistence so were able to just pay what was owed. pacenotes said:

Yes your paying to have it sorted but your part of the modern day scam with estate fees.

there's, the issue of ownership, i wouldn't have a privet hedge if it was my choice. so that becomes an issue as I'm not allowed to remove. there have apparently been cases where they have reinstated or removed plants people have changed in the past. the fact they dont come anymore my negate that issue you though Yes your paying to have it sorted but your part of the modern day scam with estate fees.
Hopefully soon it will be the PPI claims we seen.

they actually came yesterday. and mowed the patch of weeds and timed the bushes. this is down to MRS speedshop making a fuss.
I'm still going to get onto them then and find out who's the contact. because it needs to be better. shouldn't have to chase them every time.

In terms of switching maintenance companies, this would be much harder than it sounds. Everyone in the estate would have to agree to remove the existing, then all agree on the new company.
Like others have said, if it was land in front of my house, I would just take care of it myself. Or just keep chasing them, yes its annoying, but at least the job would get done.
