long shot, but anyone with a building/property on the above list/record got any hints/tips when dealing with their LPA?

long/ short story is that we applied to replace our shed (don't laugh) with a bigger one as we have no PDR- this was rejected (with a very subjective reason from the conservation officer) ...as such we then tried to have our restrictions on our PDR removed, but this has also been rejected-due to our property being on the above list (which we didn't realise at the time of purchase)

so although our property isn't listed or even NDHA what are the realistic expectations of extending a HER property (as we've basically ran out of room)?

Are you sure it's not more a case you are in a conservation area and there's an Article 4 Direction in place?

....I'm not sure that a HER confers any special protections, per se.

no, definitely not conservation area- just green belt

Does the removal of PD rights apply to your property specifically (for example as a condition on a previous planning consent) or is it a blanket removal for the area through an A4 Direction?

specifically yes- well our development of 3 properties (converted outbuildings) ...i believe this was the LPA's default position back in the day (2004) & removal of PDr's helped 'grease the wheels' for the developers

(dull) update:

we applied to the LPA have our PDR reinstated, which was rejected ...so we appealed to the planning inspectorate (via a planning consultant)- which was again rejected

but we are making progress, as the inspector rejected the 'openess of the green belt argument' the LPA used, but accepted 'there is a tangible risk that even a modest extension, alteration or outbuilding would harm the integrity and significance of the barn'

we were also informed, that as our current garden shed has stood for more than 4 years without issue, then the LPA can't order us to remove it

so now we move forward with an architect & going through planning for a proper 'modest' (single storey 30 m2) extension where the shed was/is (but obviously larger) but without 'harming the integrity & significance of the barn'- which our architect thinks is perfectly feasible (albeit we will probably have to go through the inspectorate again, as the LPA default position is 'no' to everything)

& people wonder wonder why our LPA went into special measures not so long ago

So, you're going to produce something that has already been described as harming the barn. Is the architect on sale or return?
