Neighbours and boundary

Basically the owner had rented out the the bungalow as an HMO but now are going to rent it out normally. The previous owners had built a conservatory and walkway when my mum and dad were away on holiday years ago (2008). They had planning permission but I was always convinced that the guttering and trim sill were over hanging mum and dads boundry. There was a fence there before, however they let it go because they didnt want to cause any issues.



I had a quick look at the original plans and the proposed plans. On the original they drew an existing side conservatory, which there definitely wasn't as we have photographs at roughly the time it was built.

When my nipper goes there once or twice a week he plays football (with a sponge ball) with my dad and it obviously hits the side windows.
Went to see my elderly mum and dad today and they said the owner of the house next door had spoken to them on Sunday. They said "can you not play football with the goals as we are going to rent out the bungalow".

I said to them sod it, give them two options. 1, clean the windows after a "game" or 2, I will put up a fence.

Any opinions or advice appreciated.

It's 14 years since they built the conservatory.

After 20 years, they gain prescriptive right to light, so the time to do something about it is now.

You're allowed to erect a fence up to 2m. in height (a little more than 6'0).

If he questions his right to the windows letting in light?

6ft panel up.

They shouldn't have windows overlooking your back yard like that.

That whole extension is an absolute carbuncle.

Probably, yes.

But the alternative is to do nothing, and in a few years they will gain permanent, legal rights to light over the OP's garden (at the moment, they have none, so can question them all they like). smile

Both drawings appear to show the conservatory side as a solid wall, whereas all of the other windows are clearly defined

Wow I don't usually comment on these type of threads but that's not good ! What could be a main sitting area of that house looking straight onto your property !!

Unless whoever rents is going to use that area for Pole Dancing I would be putting a fence up ....

I can just see whoever moves in complaining that you are looking in on them !

Absolutely needs a fence, tell the neighbour the plan to do so by all means but action needs to be taken

In the planning approval for the rear conservatory, it's specified that the side facing the other neighbour has to be opaque for privacy reasons.

And then somehow they've built themselves a cosy viewing room for your parents back garden ! I guess your parents must be very conflict averse as this situation should really not have lasted longer than the day that the side conservatory was built.

I agree, put a fence up, sharpish.

Given that it appears the "conservatory" is actually on the boundary (where the previous fence was) then any fence will be on your parents land so they can do anything (up to 2m) they like.

Looks like a windowless wall was approved. Not one with windows.
