who would be responsible for rejecting a cheque signed by the wrong person(ie not the account hoder)?

would it be the organisation receiving the cheque, their bank or the cheque holders bank??

The account holders bank, unless this other person is authorised to sign cheques on that person's behalf.

However, if you know in advance that it's wrong, you could be nice and save them the expense of a returned cheque fee.

my wife mistaken used one of my sole account cheques (instead of joint account) this cheque was cleared by the bank and subsquently exceeded my agreed overdraft. I rang the bank to advise them of the situation on the day the breech occurred but now I have been charged for an overdraft that should not have occurred. The charges are annoying but my major concern is that the bank have happily cleared a cheque from my account with the wrong signature, which is a security issue in my eyes.

Do you think its worth a letter of complaint?

Id be pretty surprised if cheque signatures are verified by the bank until someone claims they havnt written a cheque at which point a copy could be produced for customer verification.

I thought they didn't look at cheques at all unless someone raises a query?

There was a documentary of some sort on tv a while ago , where they signed a load of cheques "Mickey Mouse" etc. They all cleared.

Make her pay you back the overdraft charge from her own account.
