Long story short : -

Closed Current account and Savings Account 21/12/2009
Took all money out of both on the above date in branch. Signed Closure forms.

Credit card with halifax had a nominal amount of Circa 35pence left to pay on it.

I paid 50p in Branch 21/12/09 - and told to ring up when I had a moment as they can't close it in branch. But as it was left in credit it wouldn't hurt anything.

So roll forward to this lunch-time. I ring up to cancel the credit card, which goes fine and I happen to make sure that the closures went through ok for the bank accounts. They say that the Savings is closed, but the current account is open with me overdrawn. This is because of two months(jan/feb) payments of phone insurance. How is this possible when the account was supposed to be closed? And furthermore they are charging me £5 a day since 01/01/2010 for the pleasure. They say they never received the closure form but they got the savings one?

Sorry for the lecture, But where do I stand? Also re credit rating? Will this tarnish it?

Did you cancel the phone insurance direct debit with the bank and the phone company?

They should have told you about the due phone payments on the current account when you agreed to have it closed and either told you to leave money to cover them when they debited the account or get the direct debit cancelled with the phone company. Basically they should check for any due charges/interest/direct debits/standing orders etc when you close an account down and make sure everything is mentioned before they tell you the account will be closed.

It will be reported to credit reference agencies but won't have a major impact on future credit to be honest.

I'd tell them your going to the Financial Ombudsman as they've given you incorrect information about the 2 x £5 payments and subsequently charged you for being overdrawn i.e. something that isn't your fault. The bank will probably just ask you to pay the 2 x £5 charges and waive the rest as it's their error or you'll be subject to the shocking customer service of Halifax and they'll threaten to default your account and take you to court etc etc for their error.

Threatening to go to the FOS doen't really make any difference unless you've exhausted the Bank's own complaints process and have received a final response. In fact, if you go to the FOS without first receiving a final response from the bank, they'll probably just tell you to go away...

yes I agree but it might spur whoever you get in the call centre to just do a refund for an easy life.

On the other hand they might argue that it is down to you to make sure direct debits are cancelled with the bank and the originator. They still shouldn't have told you the account was closed though if clearly it wasn't.

Thanks for the replies guys. I wouldn't normally be bothered but five pound times sixty days is quite alot when you think about it. Was so mad at lunch as if I hadnt rang up the five pound a day charges could have added up for years rather than months.

Get the details for the main banking complaints dept from the branch and send in a letter. Explain clearly what happen and what outcome you would like.

Don't bother dealing with the branch, the complaints dept can liaise with them as necessary.

Yeah that's what I'm trying to do but everytime I ring up they have no record of me ringing.they really are useless. The branch has closed, i'll get in touch with the department you have mentioned. Cheers
