I recently started a job at o2, initally they asked me for a P45 but I haven't sent it to them yet. I got my first paycheck today, and I got taxed something like £38 on £198 of pay. I'm just curious if I should be getting taxed, i'm 18, and working Part time (12 hours a week), i'm not in full time education.. But my annual salary is only £3500~.

Probably stuck you on an emergency tax code until they find out what tax code you're meant to be on.

Without a P45, they have little option.

Why haven't you given them the P45. Get it to them as quickly as possible so that they can inform HM Revenue and Customs and can start operating a correct Tax Code.

I'm just not sure, on various sites it says you have a 'personal allowance' of about £5K?

If you have an employee who has joined you without supplying a P45, you should operate a 647L month/week 1 tax code, until that employee a) gives you a P45 b) signs a P46

BR went out of the window 2 years ago as the default emergency tax code.

If I had an employee that hadn't given me a P45 or P46, I would automatically put them on BR, I don't know what their circumstances are and for all I know they may have another job. (When they see how much tax they are paying it usually hurries them up to supply either form wink )

I understand fully, but it's still incorrect wink

I have a simple policy of giving HMRC everything they need to make a decision. Don't arse about with them because if money is due, you will be charged interest or, even worse, a fine in addition to the money you owe them. And if they get it wrong, they tend to send back a cheque. Life is simple this way. And it avoids any nasty surprises down the line.

As tonker says, you need to give them your p45.

You have a yearly allowance of £6475, however we're 8 months into the year. For all the HMRC know you've earned £200k already this year and that allowance is long gone. Therefore until you provide a p45 to show otherwise, you'll be taxed as if you have no allowance.

albeit incorrectly.

I think the advice here is get the P45 to them asap, and they'll refund the thirty odd quid they've already held back so far.

Perfectly correctly, as you haven't informed them of your tax position smile

(I know what you mean, just being pedantic tongue out)

I'm in the middle of waiting for a P45 from my previous employer.. If I filled in a P46 and sent it away? Would it be okay?

You complete a P46 and hand it to your new employer. HE then sends it to HMRC.

Even if the "default" coding for eemployees who fail to produce the correct documentation when joining a new employer is now 647L, there is a good chance that an employee who automatically receives a 647L coding will pay too LITTLE tax and may end up in arrears.

What is the problem with the OP's P45 anyway? Have it been lost? Did the previous employer not give you one? Is the OP just being lazy? What coding did the OP have at the time his previous job ceased?

Was your previous employment from this tax year? (April '09 onwards?)

If yes - you will have used some of your tax allowance already, from the p46 they will put you on a 'week 1' tax code until they can analyse your tax payments for the year and work out what tax code you should be on.

If no - you will be put onto 647L cumulative and can begin using your allowance.

Why is your previous employer taking so long? We do all our p45s online now, they can be done in minutes and printed off in pdf so the employee can avoid this hassle.

My previous employer is my Mum, I should have a P45 by the end of this week. Her people still do it all manually.. :idk:

But my main concern is, should I actually be getting taxed at all? I'm well below the £6,475? Will I get the tax they've taken back, and then not be taxed on future pay days?

Yes, but are you well below £6,475 if you add in what your Mum paid you?
