OK about a month ago my ex employer called me to say that they had paid me and are now wanting their money back.

Now there are a few problems here.

1) why did they still have my account details to put the money in in the first place, I've been away form the company since July 2007.

2) I am currently stuck in a routine where I know how much I have in my account, how much I get paid, how much I spend etc etc as I'm trying to get myself out of debt, so I rarely check my bank balance, so dont think I have spent the money as didnt know it was there.

3) However as I have many direct debits coming out my account its hard to tell whether paying them back in full will put me back into my overdraft by the end of the month, to which I will be charged for, which I wouldnt have if they hadnt paid me (complicated one that, just trust me)

So am I within my rights to pay them back in 3 or 4 installments so that I dont get charged by my bank for going back into my overdraft and being charged for it?

Whether you are within your rights or not to make instalment payments is a little beside the point.

Ring them, say you didn't notice, have reduced your overdraft so cannot pay it back and offer the instalments.

Faced with something like that or going to court to make recovery which would you choose?
