Hi all, Seeking legal help here. A quick summary of the issue and my question. Im having issues with a company who have negioated a succesful claim of an old loan on my behalf. The company in question have taken their fees without my consent or fully recovering the PPI premium into my bank account. The bank I won the claim against have agreed to pay (via letters) however they cant give a date when this will happen, possibly the end of June or later. I have asked for the fees (approx 1.4k) to be refunded back to me until I have received the pay out in full to my bank account. The clerk on the phone yesterday was suggestion they had phoned me weeks back to agree a date when the fees could be taken by DD from my bank account, I did agree to a date however this was to be based on the condition I have received the full pay out into my account. I know the calls are recorded so I said go get the tapes and listen to the conversations, so Im currently waiting for a call back. What is the legal situation on this? Appreciate any advice or key legal words I can use if they persist to keep the fees. Their website even states "no fees up front, only when we are succesful and we've recovered all your PPI premiums" Thank you for any help or quidance you can give.

You agreed on a date, they took the money and now you want it back until you get paid directly from the bank?

If you set a 'condition' of the money only being taken if you'd recieved your money, how did you expect the fee company to know that you had not recieved your money yet, if you hadn't phoned up to tell them and as such to not take the payment on the agreed date?

I really wish I could muster sympathy for PPI recovery issues.

Oh well.

Yes, we agreed a date on the condition of the funds in my account, the bank would notifity both parties on settlement. I checked regular with my bank for the credit up until the date the fees were due out. I phoned the PPI guys on that afternoon to say no funds are in my account and not to take their fees. The guy on the phone agreed they wouldnt.
