Why, is this not attempted murder?

http://www.dailymail.co.uk/news/article-1348225/CC...

Yes its the Mail but they didn't make the CCTV up.

Makes you feel sick (Thinforth, shh) to see it happen. Theres probably some background on it, rival gang or the like but still. 27 Months isn't enough.. 27 years is. If this woman hadn't got involved the chap on the floor would now be in a grave, the other one who was joining in on the kicking.. 18 months. No, why so short? This country is fking stupid.

Oddly, longer sentence for the dick that threw the fire extinguisher off the roof in the student/retard demo.

Yeah but the fire extinguisher chap was white so the prosecution isn't scared of having the race card played against them.
You will also notice that the fire extinguisher chap didn't actually hurt anyone, just meant to, whereas these two toerags also commited GBH....go figure.

Both cases will hinge upon what was/was not said in interview.

the fire extinguisher guy was a direct high media profile attack against the government and the middle classes.

this was just a rumble in the ghetto.

Prosecution charges used to be about the possible. Now it is about the practical. If the offenders had been charged with att. murder they would not have received any greater punishment so there was little point in going for the higher charge and risking alienating the jury.

I'd say a sensilbe choice, at least from the circs disclosed. Don't forget that this was the Mail so any mitigating circs would have been ignored or distorted.

e.g. Gang related?

Are gang related sentences less serious than if he was just an innocent chap?

Provocation was what I was thinking of. However, I would suggest tht gang related crime, where there is fighting between groups, is regarded as liable to less punishment by courts.

Isn't it also quite hard to prove attempted murder if there's no weapon? Still joke sentences though. That sort of up close and personal brutal violence should be punished harshly.

Interesting. So if you've put yourself in a gang you've effectivly opened yourself up to crime..

It is sickening to watch, and worrying how lean their sentences are. Remarkable he wasn't killed.

I'm sure I've heard before that head stamping is immediately attempted murder?

There was a thread on PH, where a someone's brother had been attacked & had his head stamped on. Caused him major problems.

I don;t know if it is, but i think it should be, i see it far too much as it's almost an acceptable part of to beating someone, before people would punch them to the floor and maybe punch them to the face on the floor, results in horrible injuries but they'll heal.

Once someone is on the floor stamping on their head is a huge force and has terrible outcomes, i think the same should apply to any kind of weapon used on someone on the floor unable to defend themselves

Yep.

I don't see why such weak sentences are handed down.. 27 months? Thats no time. He'll be out before that and be back on the street handing out another kicking. Why can't you put query why it is so short? There should be some way of questioning it and finding out the judges reason for such a short time.

Sad, but probably more than an element of truth.
