On the news just now. Seems as chairman all magistrates were in agreement when he read out the statement.
Was the Magistrate right? Was he wrong? Did his comments go too far?
" During sentencing Mr Molloy told the boys: “Normal people would consider you absolute scum.”

He said his fellow magistrates had agreed with the use of the language.

But the court clerk, Christine Dean, challenged Mr Molloy in open court, saying he had used ‘inappropriate language'.

She then encouraged one of the boy’s mothers to go ahead with her plans to make an official complaint.

Afterwards, the court launched an investigation.

Mr Molloy, 57, from Darwen, who has been a chairman of the bench for 14 years and a magistrate for 18, said: “It was a considered decision made by all three magistrates on that day.

“In my view and in the view of other colleagues, the clerk over-stepped herself and over-reacted quite far.

"The magistrate on Friday decided that I should not take the chair as that case had caused some embarrassment.

“This caused a delay to the courts and they didn’t start until 11am, an hour late as someone from Accrington was sent to replace me. It was out of order.” "

I'm with Tonker here, people like this should have to prove themselves to be fit to breed later on in life.

“Normal people would consider you absolute scum."

I'd say that was accurate. They were.

Am I the only one hoping that the clerk will soon be looking for a new career?

He didn't say they were scum, he said that "normal people would consider you scum", and that is different to actually saying he thought they were scum.

It's like saying to someone "Anyone else would have told you to fk of by now", but you've not actually told them to fk off.

It's very nearly a legal term...if he had said "the man on the Clapham Omnibus would consider you scum", it would have passed into legal folklore...

Indeed. A bit like the age old case "...if it were not for assize time, I would run you through..." (If I remember correctly from Criminal Law) - not a threat, because it was not assize time.

Is there an opening for another bottom inspector, I wonder?

i've often thought that in this age of punishments not being able to fit the crime (due to overcrowded prison, etc, etc) judges/media should make more effort to attack the thing these scum hold dear....respect, init.

If a few judges started summing up by explaining the person in front of them was a tt of the highest order...and pull up your jeans, you like like a retard....its may mean more than the ASBO!

There was a time in this country when someone caught doing that that would have been skinned alive.

They probably still would in some parts of the world.

The chair made a good call, the clerk acted like a tit. My Mother is a JP and often has to hold back what she really wants to say when she is chairing.

In fact when I saw the title of the post I was a little worried that she would probably be involved.

Sadly, it seems that most on this thread have not availed themselves of any of the research explaining how human beings work and how the fabric of society is maintained. It doesn't matter whether what the bench said was accurate (it was, after all, merely a statement of belief); what matters is that the authority of the bench is undermined by stooping to this level. Things like this - or, perhaps, the slightly, err, cavalier approach of dear old Judge Pickles - simply serve to drive the wedge further between "them" and "us".

Whether we like it or not, society is comprised of a wide range of characters and attitudes. Unless somebody is seriously suggesting an approach akin to Douglas Adams' imagined "cleansing" of Golgafrincham, the reality is that we must share the country with all sorts, and we must find a way of achieving the standards of behaviour and engagement in our vision of society that we hope for.

An impartial, unopinionated judiciary is a key part of the sort of society we might hope for. We allow its authority to be undermined at our peril; I believe that the bench's comments in this case serve only to do just that, and to support the bench's position is to support that erosion.

Not at all. Upon conviction of a crime which is quite heinous it is not beyond the realms of possibility that the majority of right thinking members of society would think the convicted person was scum.

Indeed, if say Ian Huntley upon conviction had been informed by the Judge that most of society would like to see him hanged, I don't think I could find fault with such an assertion.

I just replied on another thread with the words 'nothing changes'.

Appropriate here too. New government in power... but the politically-correct morons are still in good jobs, and will be shouting their 'that is inappropriate use of language' twaddle.

Welcome to a new era of 'Nothing changes'.

I wanted rid of New Labur like most, but you should have a look at some of the new MPs, especially the women ones, without sounding sexist. Politically-correct beyond all reason some of them.

How long before the honeymoon ends? No idea, but I'd bet anyone it ain't going full term!!
