Boy, Four, Dies In Somerfield Supermarket

http://uk.news.yahoo.com/5/20090922/tuk-boy-four-d...

A four-year-old boy has died after falling and bumping his head in a Somerfield supermarket. Harry Blackmore was swinging on a small steel rail when he fell in the store in Liverpool.

His devastated mother was shopping just yards away when the tragedy happened.

The distraught parents, who have four daughters, are now suing the supermarket giant for negligence.

They told how Harry was knocked unconscious after banging his head on the floor of the store in Park Road, Toxteth.

Mr Blackmore, 39, said: "Now we're lost. We're completely empty. We just can't believe it."
Family solicitor Rex Makin told Sky News the family was taking legal action against Somerfield.

He said: "This is a working class neighbourhood with lots of children. We say that parents should be able to go shopping with their children in a safe environment.

"We say that the railing should not have been there or should not have been in that state."

A Somerfield spokesman said: "We were deeply saddened by the death of Harry Blackmore."

Hmmm sounds like a simple accident. Why do they feel the need to sue them? The supermarket bosses must be banging their heads together. How is this their fault?

Unfortunately it is the way our culture has become. People need to blame anyone but themselves, there can't be simple accidents any more.

Tragic, but if anyone is to blame it's the mother for not keeping a close eye.

let's hope the court sees it the same way. I really despair at this sort of thing. These parents seem to have fiorgotten that the main duty of care for the child lies with them. If they told him not to swing on the rail and he obeyed (not soemthing I've witnessed recently) then this possibly would not have happened. They should have some serious questions to answer themselves bout neglecting the boy.

But extra money is OK?

Don't get me wrong, it's a terrible thing that the kid died, but I hope they get laughed at and brushed aside when they attempt to sue.

I'm sorry but I was not allowed to play around in a supermarket when I was kid (which is why I hated the monthly shop so much, it was boring!) I had to hold onto the trolley as was not allowed to let it go.

This is a tragic accident and the boy didn't deserve to die but the supermarket do not seserve to be sued either. The mother needs to accept her boy wasn't under proper control but I can understand why she may not be able to.

There's a rail where I work as well, it's up the front between the first big till and the small basket tills, it means customers queueing for the big till are separated from the staff working on the basket ones.

Have seen small children climb on it and swing on it and 95% of the parents will say "don't climb on that, you'll slip and hurt yourself", I'm guessing the 5% that say nothing are the ones who would sue us if they child fell off and hurt themselves.

The parents were obviously poor and common.
While the mother was arguing over which bottle of cheap alcohol should be bought with her just released from prison boyfriend, her child had a tragic accident.

She will sell her story to the Sun and she will be buying breast implants with any money she gets.

scratchchin Lets roll the clock back 25 years...

When I was about 4 or 5 I used to love jumping down the last 3 or 4 stairs of my parents house... one day I thought I'd really push the boat out and jumped off the 6th or 7th stair. Not having the greatest appreciation of physics at that time I inadvertently smacked my head into the landing ceiling above the stairs... it knocked 7 bells out of me...

What did my parents do?

Clipped me round the ear and sent me to bed with no pudding!!

Okay, so I didn't quite die.. but even so, kids do stupid things! Thats what being a kid is all about.

I think you're bang on the money for what it's worth. I hate tts like this. Your child is your responsibility, not the fking supermarket's.

I hope waitrose make a financial offer to a charity of the parents choice for children. Maybe pay for some kids education such as tufty club style thing.

Just to show the parents are just after money and a person to blame, as I doubt they would think this as "fair". They need a new car dantcha know

First of all this is a tragedy and I’m sure all our hearts go out to the family.

Second, the story implies that the railings were the ones outside to stop trollies and kids flying out into the car park and traffic.

So, the child was left outside while the mother was inside shopping.

If that is the case then I’m sorry, but this is the fault of the family. Unless, the railing structurally failed in some way.

If someone had left a child outside and a paedo had grabbed them, whose fault would that be?

If the mother did leave the child outside, after what happened to Jamie Boulgar and the fact that every living human in the UK knows this horror story then that mother had better start coming to terms with her guilt as soon as possible, for her own sake and for that of her remaining children.

nono I say, you should have been paying more attention to your Son rather than chatting to the rest of your street, who were doing the weekly shopping after picking up their Giros.

Yes it's a massive generalisation and quite incredibly stereotypical, but kids will caper around - that is what they do. It's up to the parents to monitor and discipline wayward behaviour.

Anyway, it's still a tragic loss and my sympathies go to the family.

Hmm, one might suggest it would be a fair swap.

Of course I wouldn't suggest that, just being extreme. However, I think its sad that the first things on their minds are to sue. Although, having said that, its more than likely the blood sucking solicitor went to them...

I’ve really enjoyed reading your post and chuckling at your stupidity.

But this is only because I did exactly the same on a set of concrete steps in a multi story car park.

When I was 18!!!!!!!!
