What a joke!

Guess there is no such thing as 'accidents' these days.

There has to be a fricking limit on responsibility here. It's not like the agency can guard against falling branches FFS! It's one of those unfortunate events, just like in guy whose cows got fried in the other thread. You can't foresee events like this.

As sorry as I am to here about her resultant problems, that's just life I'm afraid. And I have no sympathy for her if she thinks she is owed some compensation by people who do not control nature!

Whenever I hear about cases like this, it always reminds me of 'The Man Who Sued God' with Billy Connolly.

If France can get away with no health and safety, why do we need it?

The scope of my job is severely limited by these s.

“The branch that fell on her had no leaves or shoots and was clearly dying or dead and landowners the Environment Agency should have known to remove it.“

Erm so if it was that clear why did she walk underneath it, I hate the way the victim in anything is absolved of any contributory responsibility.

So it's akin to falling in the sea and claiming damages from the Coastguard because they'd not told you it would be bloody wet and bloody cold?

Exactly.

You need to ask yourself how often this happens as well.

Or to put it another way;

Was it negligence on the part of the agency which led to the branch falling? No...it wasn't. If common sense prevailed, this would be the end of it.

But no, the court will rule on the side of the woman, and the public will have to pay for the inspection of all the trees under the EA's control.

Just close all parks to the public and then turn them into social housing

There is some huge parks in London that would be perfect.

FFS. I think we should take out a group action and sue her. Because of her stupidity being unable to assess the risks to which she is exposed, she is curtailing our ability to enjoy the trees. If councils have to cut down all the trees, then I will suffer great mental hardship. If we all sue her for half a million quid each, she might get the message.

There are big signs where I work: "The Person Responsible for your Health and Safety is YOU". We ought to make every UK citizen sign something similar if they want a UK passport.

I agree with this wholeheartedly. I simply do not understand this country sometimes, it is ridiculous. Why can't people just be sensible? What has happened? Why do people feel the need to sue for the most outrageous things these days? Soon we will have to sign a disclaimer every time we go outside to make sure that the councils wont go bankrupt. What a stupid selfish woman.
Grrrr.

There are limits to how much you can protect idiots from injuring themselves. And Darwin would suggest we already go too far.

FFS rolleyes I love it how they come out with all this st after a small accident.

She got a cut on the head from a falling branch and now she's "handicapped".
