Infamous looney blooger, Old Holborn, is planning to perform some citizens' arrests upon dodgy MPs a week tomorrow... if I can make the time, I for one will certainly be attending. 9am, 1st June, Palace of Westminster.

zanulabour will use it as an excuse to enact some law depriving us of something important i reckon...just because they been exposed doesnt mean they like us all of a sudden....

What we really need is hundreds of thousands to attend. Then the police can do nothing.

Pledge to take next Monday off work and storm parliament. You know it makes sense!

In fact, on second thoughts it is the police's duty to join in against the troughers, moreso than the general public.

I think that could possibly start a riot. And I would imagine that the police would be more than aware of that, especially if it's televised.

Uh, actually I think suspicion is sufficient to prevent a crime being committed (as long as that crime is an either way offence) - I could be wrong, it wasn't really part of my training, i.e. if you see someone breaking into a house and you reasonably believe they are stealing then you may make a citizen's arrest........

IIRC to arrest for an indictable offence ( Fraud) a MOP must KNOW that the offence has been committed and that the person they are arresting has committed it.
Many of us SUSPECT that MP's have committed fraud but I would argue that we do not know this. ( how can we, based on media reports )

Only the police can arrest on suspicion, and therefore I would say that this person is on very dodgy legal ground indeed.

Of course, if you disturb someone breaking into your house, car etc you DO know that he is committing an offence so the problem with suspicion does not arise.

Nope, some of the MPs have lodged claims for mortgages they don't have. The paperwork is evidence. If we suspect that such an offence is being committed then a citizens arrest can be made (there is the clear differential between a citizen and a plod arrest though, the offence must be in progress at the material time, save for arresting a felon at large IIRC)...

When someone breaks into your house, you do not know that they have the intent to steal, they may simply be trespassing or committing criminal damage by breaking a window.. I am reminded of the case of the fellow outside a Post Office with a swag bag............

A citizens arrest can be made if someone suspects that an indictable offence is being committed (which is the example you gave actually) i.e. they suspect that the chap breaking in to their house is going to burgle it.

No. But the police could. I must add, it's ages since I studied powers of arrest. A real police officer may be along to clarify. smile

The only reason there isn't concrete proof thus far is cop have been busy out waving speed cameras at hard working motorists instead of investigating fraud at Westminster...
