I would be surprised if the judge followed sentencing guidelines in this matter.

I reckon we send far to many offenders to prison in this country. It is expensive and, more importantly, counter-productive as the recidivism rate is much higher than with other punishments. In this case, I reckon I would make an exception, their age notwithstanding.

The 180 days intensive supervision seems a bit nonsensical - is it a copper following them round to make sure they're not raping anyone that evening?

The flip side is- what would prison do for them? (I know it would give victims peace of mind). Some people might be scared enough of it for it to be a short sharp shock.

But the fact they've done this twice already makes me doubtful.

Ideally I would want punishment to force the rehabilitation of offenders. Some sort of enforced service in an area where they can see the consequences of crappy behavior? But it would have to be at no risk to others.

Letting the borstal system (as was) chew them up and spit them out is, in all honesty, not that much use. But it would make people feel better i suppose. Tricky one really.

I agree about the borstal system.

I did a home search for one 19-year-old lad. His parents were upset but welcoming, even offering a cup of coffee. While chatting to them, they told me their lad had been sent to borstal under something akin to the short sharp shock nonsense and the turnkeys had allowed them to smoke cannabis after hours to keep them quiet. When the lad came out, he took up with a new group and eventually went on to harder stuff. I'd nicked the lad for burglary of commercial premises (one with a silent alarm, a gift for me) so I assumed his first offence was something similar.

He was taught how to march and not much else.

Other countries choose different methods, most of them with a significantly greater success rate with regard to recidivism. But the press would not allow such sensible options.

I was a normal sort of lad when I was a kid. I played in shunting yards, jumping in and out of trains, but did nothing dishonest. Unless you count burning down three tenement blocks - another story, or actually none at the end of it. But kids will be kids. These boys were serious offenders, and there should be concern about the signal it sends. I know that a lot of youths believe the law can't touch them and this is mainly because we use prison, not really appropriate for most youth offenders, far too readily for adults so anything less is seen as being let off.

You cannot rehabilitate monsters like this. They are old enough to know right from wrong, but they still chose to engage in some of the most selfish, appalling behaviours available to them with no concern whatsoever for their victims. Anyone who could do this has something fundamentally wrong with them.

By handing out these shockingly lenient sentences, the justice system is telling them that their crimes are not enough to garner any real punishment. What does this say to other boys and young men along consequences to their actions?

When I was a kid of the same age two of my mates got 6 months in borstal for nicking bicycle parts from a shop. Neither has been in trouble since. How times have changed.

I did say minimum, twenty years would be better, but you have to be realistic, they are letting inmates out atm because there are not enough prison places, the answer clearly is to invest and build more prisons

From the outside it looks like sentences have been getting shorter for serious crimes for decades, when there was prison capacity.
