How the hell is that anything to do with the car? Surely the penis owner (if the man in question had a penis as you never know these days) is responsible?

I've just read this article.

The lady claims she was injured in the vehicle, and that her ex's car insurer should cover her losses.

Arbitration and the court agreed with her.

What didn't seem to help is that the insurer (geico) just refused to engage, and ignored it. What they should have done was to submit a defence as to why they weren't liable.

The BBC article still describes it though as "may" have to make a payment.

Whilst the lower court's decision has been upheld, it seems there is another process opening for Geico to challenge this.

Personally, knowing how capitalist the USA is, i am surprised a judgement would go agaist a big finance company like this, or it being allowed to stand for long.

As for the issue itself, pfft. Most Americans think protection is a handgun, and will insist two gametes that just met must be entitled to the right to life. It is a ridiculous country.

Injury/medical condition occured as a result of being in the insured vehicle. Only in the US.

Only in the USA, I don’t see how they are liable for her ‘injury’ , unless she actually tried it on with the car, and got a dose as a result

I would give her a clap , but she appears to have had that already

It takes two to tango so they should go 50/50.

Possibly apocryphal, however just today I read of someone who injured themselves throwing a boomerang that then ttted themselves in the face.

They had liability insurance, and successfully sued themselves for negligence which was won, and paid out by the insurance.

Merica.

Can’t wait for the ambulance chasing lawyers TV ads on this one.

Or better still… the new GLX. Now with a condom dispenser built into each of the seatbelts for your protection.

Yanks are funny.

Being the yanks, it'll be a full legal document to be signed before sex absolving anyone of any blame, plus an NDA

Did they only have sex in the car? If not how can you tell where she contracted it? Will she sue house insurance next? Back of the local nightclub in an alley, I’ll sue the local authorities etc.

This. If only the insurance company had shown up and said this, they'd have won I'm sure.
