Hi,

I have been working in the Middle East since the 20th June. It's possible I might be here until mid April.

Now I have read the bit by hrmc and it sounds like if you're away for the whole tax year and do not come back to England for more than 90days you can claim your tax back.

So if I go back to England after the 5th of April then would I be able to claim my tax back or have i read it wrong?

It kind of sounds too good to be true. What would I need to prove this , a letter from work ? Flight details? My contract has been a 2 month rolling one and I'm fully employed by a UK plc.

have you been paid into your uk account in stirling?

i would speak to your company tax accountant, they will be able to provide better advice than we can.

Im sure i will be corrected if wrong...

In order to not pay UK tax you need to become a non UK resident, you can do this at any time throughout the year. However if you become non resident today, you need to stay out of the UK for a complete tax year, so from now until April 2015. (Obviously you will be allowed back into the UK but you will be limited to 30/60/90 days depending on your situation, number of dependands, if you own a house in the UK, if you have worked in the UK for the previous whatever years bla bla bla

If you return into the UK before that that year is complete to live/work i.e before April 2015 - you are liable to be taxed on ALL worldwide earnings from the day you claimed you left

And the above would be a situation for someone that maybe became non resident and moved to Dubai, lost their job and had to come back to the UK. For your situation, you have been working in Dubai as still remain a UK resident i presume so im pretty sure you cannot just rock up and say "Hey i was out of the UK for 10 months, i want my taxes back"

If you think it sounds to good to be true, it is.

The UK make it very hard for anyone to stop paying taxes haha

I don't remember reading about residency but will go over it again. Of course they make it hard...yes I have been paid sterling into a uk bank account.

Just re-read the criteria....best to forget that one then....when will,it be my turn for a huge tax rebate!!

do you have uae residency? overlooked that!

i'm afraid you will have to pay tax on the lot, your situation looks very much like a secondment and the taxman will see it the same way.

No i don't I'm not in UAE I'm in doha...and it's a right bk ache to get a RP. Most newbies here like myself do a visa run every 2 months

I had a RP within a couple of weeks of arriving in Doha.

Hello from Doha too!

Getting an RP is very straight forward with a PRO who does his job. It took me 8 weeks to do it with a st PRO, then we got a new one and now it only taking 2 weeks for our new staff.

OOH actually I have a tax question maybe someone can also answer. I moved away from the UK in 2008 and never filled in any tax forms or anything. I just hopped on a plane and off I went. I've spent 2 weeks a year max in the uk since, am I going to get in trouble if I go back to the UK to work because someone in my office said I should have filled in a load of forms to declare I was leaving, (no house or assets in the UK).

I moved overseas for 5 months, which then became 15 years and counting. I paid tax on the 1st year and then claimed it back when I declared myself as non uk resident. As stated the number of days you can spend each year in the uk is linked to properties owned / family living in the uk etc. After 5 years of not living in the UK you don't have to file a tax return, or at least this what I have been told and hence not filed a return for many a year.

I'm not really fussed about the RP this way i get a free break to dubai evey 2 months!

i was self employed in my last year in the uk and dissolved the ltd. co. under the advice of my accountant on the 4th april. i then did not work until coming here on the 28th. the advice was that i didn't need to do anything other than file that year's returns.

i;m now being chased by HMRC for 1200quid in fines. i don't owe any tax but apparently i ignored a letter for hich they fined my 300quid per quarter. all thanks to my lovely ex tenants who threw all my post away.

If you don't owe any tax, you're not liable for any fines, as these only relate to non/late payment of tax. Are you up to date in filing your tax returns?

yeah they didnt receive the return, which i sent from the uae as i remember posting it. i know i don't owe any tax as my accountant settled it all and told me what cheques to write and to whom before winding up the company.

i am sure all the above will fall on deaf ears.
