key fob wont open doors/set alarm.

my wifes 2006 MX5 1.8 is playing up.
The alarm fob is the folding key type with 4 buttons and a led.
This started by the fob not opening the doors and turning alarm off.I did the obvious of changing battery and this worked ok when i tried.It would work from a big distance.The next day she told me it would not work again.I tried and she was right.walk up to car and nothing.But if i put the key into the drivers door and open the lock then press the fob the lights flash to say alarm is turned of.open door start engine shut door and used the fob and it worked.went back later and it would not work again.BUT if i open with key again then use fob it will work.
Any ideas? Been to local mazda and told that is a new one to them and they would not know where to start!!!

Might be a bad contact to the battery, has it been dropped in dirt or a puddle? or mabe been through the wash?.........my mrs would never in a million years admit to any of these so give the contacts either side of the battery a good clean - just to be sure

ETA: Might also be a good idea to leave the fob on or near to something warm overnight (hot water tank) in case it is also damp inside.
