Hi, started work with a construction company, 3 weeks in decided it wasn't for me. Looked at my contract to see what notice was needed. Up to one month, no notice given, so told my boss it's not for me and that tomorrow would be my final day.
Anyhow now not been paid, so my question is do I just take him to a small claims court?

I might be stating the obvious here and may sound a bit patronising but have you told them youve not been paid?

Ive worked for companies for a while and randomly not had my wages one friday due to an office stuff up.it happens.

1. How long ago was your last day?
2. If less than say one month, write to them and ask for it
3. If more than two months, go straight to ACAS Early Concliiation (internet search for the link to start it)
4. Once ACAS is concluded if no joy then ET claim within 28 days of the EC Certificate being issued

Before going to ACAS, wouldn't it be advisable to actually ask the company for the wages and go from there?

Surely he's already spoken to his ex employer? I assume it was implied!

Hence my 2 and 3. If time is in issue however go straight to ACAS to avoid being timed out of any claims...

Most employers run their payrolls on a monthly basis - for ALL their employees at the same time. It’s usually not possible to run a payroll for just one employee individually.

I reckoned n that’s the reason they haven’t paid you.

They will also give you a P45 - after they’ve run the payroll.

Not construction, most site based staff, weekly, presumably this payment period would also be noted in t&C's?

OP was this a large structured company with HR departments etc, or a small firm being run by the boss?

Small firm. Boss does the sign-offs

How long ago?

If over seven days, write again and advise you will start the Early Conciliation process if payment is not made by X date (another seven days IF you have enough time left)

So that you have a nice record to put before an ET if it comes to that.

He's probably a bit pissed off that you only worked a few weeks then did one.
