Redundancy and notice periods

in to redundancy consultation for the second time in 8 month

This time, rather than fighting to stay I have no desire ton remain and actively seeking to be one of the people made redundant

There is NO work for the business unit I am in but they are keeping some people in the hope / expectation of some work being confirmed

Contract is 3 months notice

Redundancy would be statutory minimum - 3 months notice period, 12 weeks redundancy (56 years old so 1.5 weeks per year of service) plus accrued holidays

Can the company force me to work my 3 month notice period or I can request to leave at a given point in that 3 month period with a pro-rata reduction in settlement

Hoping I am offered PILON but fear that business will request me to work the 3 months, despite me having no work to do

You would usually expect PILON - no one wants zombie employees around, really. It’s no good for anyone. But it’s something that they can offer rather than a right you can demand, as I understand it.

Your contract will tell you - the most likely answer is that yes they can. The contract will almost certainly state that PILON is at the option of the company. It may also however state that on PILON you are entitled to salary only (i.e. no benefits), at which point garden leave may be more attractive (see below too).

But the chances of them wanting you past any handover are low IMHO. But do also bear in mind any restrictive covenants.

If this is the second time in eight months, then you've been in this job for less than 2 years, so you're not entitled to Statutory Redundancy Pay. frown

I read it that the OP ‘survived’ the previous round of redundancies. 12 weeks statutory at 1.5 weeks per year would suggest a minimum of 8 years continuous service.

Second part of consultation today and all went according to plan

Redundancy confirmed effective from 28th March

Obviously paid up to end of the month, 3 months notice, 12 weeks redundancy and accrued holiday pay - no need to work notice

Start new role on 2nd April - could not really have worked out better but needed me to take a leap of faith and a very pro-active approach

No need to, as current work is under a high level of security clearance its all been removed from me so effectively been on garden leave since the redundancy consultation started, by the time I start my new role I will have been effectively "off" for about 6 weeks
