Employment Tribunal - Judge's notes

I'm trying to get hold of the judge's/tribunal's notes from my ET. After being led to believe by the ET office they're available under a Subject Access Request, I'm now told they can only be released upon the order of an Employment Appeal Tribunal judge. I was told this by a letter from the Tribunal indicating this information has come from another judge.

Is this true, or is this another example of somebody not correctly interpreting the Data Protection Act rules?

I'm not intending to appeal my ruling, but want the notes for another issue relating to my case.

The Judge's notes will not form part of ypur case file to which the DPA does apply. I haven't heard of notes being disclosed other than as part of an appeal. I do not know the specifics of the DPA applicable to notes taken by the Tribunal but would be surprised if they must be disclosed.
