Hi all. Looking for some advice please.

I'm currently working my notice period with my company. This was 90 days, and my finish date was 31st October. Although I'm going to be working for the same organisation, it's a different business group, so had to resign from one, and start with another. My service isn't broken, and don't need to go through a probationary period which is good!

However, I have holidays left to take, and had planned on taking these over October to get a break before starting my new job. My HR Manager told me that they may be able to give me an early release date, and that he'd let me know, fair enough.

Yesterday I applied for holidays in October, only to be told that it looks like they will be able to release me on 31st September. I will be gainfully employed at site in my current position until the 30th September, and if I finish on the 31st will lose my holidays. I know I will be paid for them, but I was really wanting to use them to take a break, as I have deferred them to support our business needs recently.

I guess ultimately my question is, can my current employer force/make me leave early, or can I opt to work my notice period? He has already contacted the HR department of my new employer about an early release/start date without my consultation, which has annoyed me!!

Are they aware that you want to take holiday? As its all the same org I would have hoped a conversation between all parties could resolve this.

They are now aware that I would like to use my holidays rather than lose them!

My issue is that my HR manager hasn't consulted me about my finishing date, and taken it upon himself to speak with my new HR dept. I don't think this is right.

It was probably not the cleverest thing to do (it happened to me when I left Microsoft some years back), however, assuming everyone is professional, a discussion should be able to sort. I'd forget about what was done (wrong or right0 and just focus on getting a resolution.

Cheers Gary. I'm not going in to the arguement of who'd sone what, but more interested in getting a resolution. As I said, I'd just rather take my holidays, rather than be paid for them.

Do you know though, can they force me into the early finishing date, or can I opt to work my notice as per my contract?

I am no employment/contract expert but I would say the only thing enforceable is what's in your contract of work. All else should be negotiable.
