If there are potentially grounds for a constructive dismissal claim does an employee have give and serve their contractual notice period?

If the employee considers the contract breached as a result of the conduct of the employer, then they can leave without notice. Bear in mind that the bar for Constructive Dismissal is very high, and if the employee took a couple of days to think about it before resigning, it probably wasn't bad enough conduct to warrant constructive dismissal.
