I started a new job two weeks ago but the employer is a complete arse and the work isn't at all what i was told it would be in the interview! i hate the job and the people who employ me!
now first thing they done before i saw sent out to any jobs or work was to sign a contract stating il give a weeks notice but also states i have a 6 month probation on this job!
Now I have been offered another job and have told my current employer I wish to leave and hand the van back but he is adiment i work the noice even though i really dont want to?
can he inforce this and if so how can he inforce it?

You're obliged to work the weeks' notice, but I'm surprised he's not just cutting his losses on it and letting you go.

It's only a week - just get it done and leave with your conscience intact. Your new employer should understand the requirement to have to wait a week or so for you.

As above, a week is nothing. Work it, and work it as well as you can (ie don't work to rule if something needs doing). Be the more mature party here - you won't regret it in the long run I can tell you smile

well the problem is i already have a start date that co insides with this notice and had to take this start date to get the job!

No other way out but to contact the new employer and tell them you thought you had agreed to leave straight away, but now the boss is forcing you to work the week, or similar.

well they force me to work 11 hour days with not break what so ever! lunch break is paid through but never offered to take it!
i was given a un road worthy van to use!
the work is not what i was contracted to do at all.
they are very rude anytime they talk to you!
i have been forced to do un contracted hours more than once!
this is in two weeks!

A short letter, stating that as they have broken every health and safety rule in the book, any contract is actually void. Any attempts to make you work notice will result in you taking these (listed) illegal actions up with a solicitor, and the 'authorities'.

Resign and leave immediately. Document your points above in writing (recorded delivery or whatever), state mutual trust and confidence has been destroyed by their unreasonable demands and behaviour, and that you are therefore entitled to treat yourself as discharged from any obligations under your contract of employment.

thanks very much new pod. i have spoken to my aunt who is a very high ranks hr director and she said either make a compramise with them but state you want working condtions to change or tell them they have braken the law and that there in reality very little they could do to me!

Yep, if all that's true then you've got them over a barrel.

This, but say you don't want to leave them in the lurch and would like to give a week's notice. The new place would expect the same..

Unless of course you've already called the current boss worse than st at the interview for the new job. In that case, have a dump in his favourite coffee cup and walk away laughing. Don't expect your final pay packet though wink

Save the legal / H&S threats until you really need them.

No, not that, the contract is void. Just leave, it's not a threat, it's a fact and his right.

i offered a weeks notice to the guy not the full two weeks due to that actually being all that is required in the first year of employment anyway! i told him i wouldn't do over time and wanted my breaks that i was entitled to. he denided not giving me breaks once i used it against him but said the work needed doing some how! anyway he demanded two weeks so didnt work a notice which didn't suit him or me really but he wouldnt budge.

As I understand it, one week of notice is only due after one month of employment: http://www.direct.gov.uk/en/Employment/RedundancyA...

That said, if you sign an employment contract in which you both agree that you shall give two weeks notice from day 1 of employment, then that is what you are contractually obliged to give.
