Most track day organisers stipulate road legal as a way to make sure that all the cars attending are up to scratch and are not deathtraps.
If the car is not road legal then it will have to be scrutineered to ensure it meets a minimum safety standard (usually to MSA standards - similar to MOT, but includes roll cage, fire extinguisher, engine cut-out, etc).
It is worth checking with the track day company before you book though.
