Hi folks

Not fair for me to name the provider here and it's against the rules. However, I booked a track day to take place In July 3 days ago (Monday). Unfotunately lte last night the car we were taking has suffered somewhat of a catastrophic engine failure! This leaves us with no car to go in.

I called the provider this morning and was told i could only have credit to reuse with them. I couldn't get a refund to my card. I also must rebook within 3 months, which since my mate now needs a new/ rebuild of his engine, isn't going to happen, he has a kid on the way and getting rid of the car was potentially on the agenda anyway.

My question is, an internet purchase, 3/4 days in, I have a right to cancel for a full refund don't i? Within 14 days? Are they allowed to ring fence £400 of my money and just hold it? Plus also just take it from me when i have no means of using the credit with their time frame?

It was booked on a credit card, so i guess if they don't play ball i can lean on the CC company?

Whilst it doesn't directly answer your question there are numerous Facebook groups related to Track days where people are always advertising their slots on the events for sale as the organisers will usually allow a name change free of charge.
It seems most people do get the full event price back on sale, especially when the events get sold out near the date.

May be an option for you.

I don't think you have a right to a refund because the car is now broken, I can imagine if the organisers had to do that everytime a track day enthusiast broke their car it would be a a lot of messing about.

On test days you can generally cancel for a full refund so long as you do so more than a week before the event itself. Later than that and you still get the credit.

Check their own cancellation policy.

Distance selling regulations do not apply to events.
Yes it is a pain when people book and then cancel, you can play excuse bingo.
That said the short time between booking and cancelation I would hope you would get a refund even if it was less a fee.

Unable to cancel for a refund within three days of booking and a full month before the event? Not good enough.

Rebook within 3 months is mean too.

Can you rebook in 2.9 months and then rebook again 2.9 months after that? May need to just keep on top of the admin and avoid this TDO in future.

I dunno which provider this is but thought it was worth mentioning that I had a catastrophic track car loss just before Christmas and a day booked for Donington on 10th January - with Javelin.

They credited the fee to my account no quibbles, or I could have had a refund minus 20 quid admin fee, either of which I felt was fair.

I chose to take the account credit, and it's still there and available for me to use once I get my st together.

Sorry can't help OP but a thumbs up for Javelin as I was less than 2 weeks away from the event, lockdown murmurs were in the air, and I couldn't have blamed them if they'd required evidence of the loss, or plain refused to help me - but they were spot on despite the circs.

What did the cancellation terms state when you booked it?

you have to book within 3 months, but the booking doesn't have to be before that date....... Don't see what the issue is personally.

Was on my mobile, didn't read them all, of course. If i have to take credit i will. Just seems a tad off after just a few short days, fir someone who has booked more than a dozen days with this provider.

Correct, but how am i supposed to know when i can next make a track day in say 6 or 12 months time? Particulrly 2 of us, in a car that might not exist?

From what i understand this is a one-shot deal too, one rebook and that's it, they eat my £400. biggrin

I did a day with other 3 mates in an old 1.0 polo and honestly it was one of the best days I had. Absolutely flat out bouncing off kerbs.

Advertise the day on here, it'll likely be sold within the day. Phone the TDO and swap the name over. Job jobbed.

Trackdays are in very high demand at the moment, suspect everything in july and possibly all of august too is now fully booked.

Thanks all for your responses. 2 things to update:-

1. Pal and I are currently Formulating a possible plan as suggested for a cheap shed we could take for a blast. So thanks!

2. Probably not a big coincidence based on where this is posted, but someone randomly PM’d me from the TDO and asked if it was them. I now have a named contact who has told me if I make my mind up within the next week, they’ll get around the red tape and get me a refund, direct to my card! Which is great. The power of this place sometimes is great.

Lucky you, have advertised 3 evenings booked out for what was the end of May and June( advertised 6th May in Trackdays here wanted/for sale and no luck at all.All 3 sold out for weeks.Engine went at a Snetterton Eve in April.All non refundable.OT at least give you 2 years the other 3 months,both do driver changes.If I was going to carry on with trackdays I would now book one at a time in the current climate and put my name down on reserve lists,as its first come first served.And you dont get caught out.Good luck
