Got knocked off bike by Van

Bikes ruined, I'm beat up with a hole in my leg. I have the guys name and number and reg and a witness. Can I claim against his insurance? Just at A&E and will file a police report later. Police said they were too busy and as I hadn't been knocked out they weren't going to send anyone and to log an RTA online. Never had to go through this before.
Some clarification. It was broad daylight and he pulled out of a t junction my right of way. Young driver and was obviously in a rush.

Sounds like a pretty straightforward insurance claim to me.

If you need some help, I can recommend Leigh Day who are/were British Cycling’s appointed solicitor. It sounds like a self employed delivery driver so hopefully the registration comes back as correct and for the right vehicle. You can check using the gov.uk MoT or tax check website. Plod won’t like him leaving the scene either.
If it comes back as Uninsured, you can claim through the Motor Insurance Bureau which is a bit of a faff but fairly easy to navigate.

They left a name and number, as well as a registration. You can get the insurance details from the registration alone generally... as long as they give their insurance info in a subsequent phone call, I'd say that's reasonable.pablo said:

I got his insurance details online. Will see what happens. Bit annoyed as It took me a while to find a bike in the size in wanted, so sure i wont get one any time soon. Doubt ill be riding for a couple of weeks now as im fairly immobile.
if you're not wanting compensation for your injuries make that clear to the insurers and they'll fall over themselves to sort you out quickly.if you are then I can also recommend speaking to Leigh Day but it will take a few months and possibly visits to tame doctors (obviously no idea how that works at the moment).
Similar happened to me although police attended and took my bike back to the station as I was taken to hospital by ambulance.
I claimed on the driver's insurance through a solicitor (plenty in the back pages of cycling magazines). Her insurance company paid for my bike, clothing, personal injury and legal fees.
I had to do some work afterwards to assist, provide quotes for repairs, cost up damages and photograph the scene etc.

Sorry I hate ambulance chasers and compo but if you are beat up and a hole in your leg get yourself sorted both bike and person. Don't sign away and feel sorry for the driver. Some clarification. I was re-ended and ended up claiming for back/neck pain which was genuine. The insurers said how do we know it's genuine. I explained my wife was I'm the car and she didn't claim as she was asleep and I was crouched/angled looking for a clear spot out of my MX5 window when I was swiped at speed. It bloody hurt.
Don't man it out. He's insured for a reason. What I hate is those throwing in a speculative claim or phantom pain.
The insurer said sure we'll pay but will sign this disclaimer stating you wouldn't revisit if it got worse? No.
I asked the same question here 18 months ago, and went with Leigh Day following the advice.I wasn't with british cycling either. I don't like to make a fuss, but like others had said, the driver is insured for such incidents and if you have suffered losses and damages then you have every right to make a claim.
Leigh Day are still handling my claim, as I still have no sensation on one side of my face and now have a metal plate fitted to my orbit bone following a tripod fracture from the accident.
It's taking its time, but they have always responded quickly and sent me to various professionals, from facial experts, to MRI scans, and given the current climate I don't expect it to be settled any time soon. I need to see the facial expert again to see if any sensation has come back to my face, sadly it hasn't. I have however received an interim payment for my losses at the start of the lockdown.
Rest up, and don't let this mishap put you off cycling, I couldn't ride for 3 months, but once you get back to it, it's like you have never been away.

I've gone with a local no win no fee (I feel a bit of a sponger saying that, I too hate the idea of compo and am all too aware of people claiming for stuff get a quick buck but I am in a lot of pain and the guy drove like a total moron. I just hope there is no lasting damage and can continue on with life as normal).
I know that Leigh has been recommended multiple times but my Mrs is a lawyer, and many of her lawyer-ing friends have recommended them.

Jesus. Just shows how dangerous it can be, you have my sympathies it must be properly frustrating. I cant believe I lasted less than 2 weeks on a road bike but I am looking forward to getting out and exercising again. Don't be wet about "compo". It's exactly what it says on the tin. To "compensate" you for loss and injury. No-one out there has a right to bust into your home, punch you in the face, and smash your telly. Why should you sit back and accept the equivalent out on the road? I got hit by a van on a roundabout. Initial contact with their insurance/solicitor was positive, then their position became entrenched. I wanted my bike replaced "new for old" and all my clothing too. They wanted wear and tear taken into account. Despite having had the air ambulance attend I wasn't after injury compensation. I just wanted my bike and kit replaced. I think that would have been between £2k and £3k. In the end their side suggested I get a solicitor myself. So I did. And they got a psychiatrist involved. My claim in the end was settled at £14k, excluding my solicitor's cut. And the driver's insurer paid for my additional physiotherapy too. I had no need to lie, exaggerate, or embellish. Oh, and my injuries? At the scene internal bleeding was suspected, hence the air ambulance, several police cars, and the complete closure of the A30 while I was treated face-down on the road. But it was "only" a fractured scapula in the end. If the driver's insurer had been willing to play ball with me directly they could have settled the claim for a whole lot less too.
