Knocked Off My Bike
Discussion
Car sideswiped me as it was coming onto a roundabout and I’ve ended up with, amongst cuts and bruises a fractured pelvis. The police are trying to find the driver. I’m not insured so can I do anything regarding a claim if the police are unsuccessful.
Anyone reading this who cycle without wearing a helmet, seriously think about it, mine was split nearly in half.

Sorry to hear, ive had pretty much the same with a DHL van, although a combination of him realising i was there at the last second and me taking evasive action he missed me by about an inch. I now take roundabouts with the expectation that any approaching traffic hasnt seen me, its just not worth it otherwise.

Not good for you at all. I hope you mend quickly.Anyone reading this who cycle without wearing a helmet, seriously think about it, mine was split nearly in half.
If the police are unsuccessful, who would you claim against?
Hope you mend well, if it had to happen at any time of year I suppose now is the best time. I know someone know skidded on ice a few years ago in march and broke his pelvis as well. Basically wasn't riding his bike properly until late summer.
My home insurance (John Lewis) covers bike for theft in and away from home if locked as well as accidental damage. Not cheap but cheaper than separate bike insurance.

Ooh you’ve done it now with your helmet comment
Hope you’re on the mend!
sorry to hear that and I hope the police find the person who did it. Did other motorists stop for you? Hope you’re on the mend!
I have been knocked off my bike my 30t sewage truck. Helmet took an almighty thump on the pavement and I ended up with quite a few scrapes, but the Brompton survived pretty well. I do approximately 2500 miles a year just commuting and I won't leave the house without a helmet. I don't see any valid reason why you wouldn't cycle without a helmet.
James Cracknell still believes that without a Helmet, he would have been left in a vegetative state after his coming together with a truck mirror at about 60mph.

Having commuted on a bike in the 80s and 90s and coming back to it for fitness I approach EVERY junction on the basis that none of the drivers have seen me. I have regularly been proved right but not hit one, or been hit by one, yet.I got taken off my Vespa in South London earlier this year in a hit and run. I was left in the floor with a broken collarbone.
Plod turned up said that there are so many cameras they’ll be able to locate the driver.
Plod never managed to, gave up almost immediately citing the car had false plates. If I could give them a description of the driver that would help! Oh yes I completely remember I had a great view as my bike struck the side of the car and fell on top of me.
OP In summary currently going through the MIB for uninsured losses, helmet, coat and other stuff.

Contact the Motor Insurance Bureau, it’s the fund a tiny bit of all our premiums support for situations like this. https://www.mib.org.uk/making-a-claim/claiming-aga...
There are loads of examples online of previous payouts for similar injuries. MIB take a while to do the admin and you will need to be consistent with your description of events and fully explain the circumstances, attend some out patient clinics etc, it will take about a year to settle but you should be expecting at least £10k.
If they do find the driver, Leigh Day are worth a call and have lots of experience with cyclists
And then join a Cycling organisation like Cycling UK or British Cycling for the free legal cover and support

Against whom will you claim?
As above, MIB are there to compensate victims of uninsured or untraced drivers. Schemes operate differently and the latter, which seems likely here, will require the MIB to carry out investigations. The onus is on them to do so once they have been properly notified of the claim. If you engage a solicitor to represent you, the likelihood is that it would be on some form of contingency fee agreement whereby a proportion of any payout would go towards the legal fees. There is a contribution to legal fees under the untraced scheme from the MIB, but it operates differently to the uninsured scheme.
The scheme is there to take account of any uninsured losses. For example, if such a collision occurred whilst you were in your car which was comprehensively insured, you would be required to deal with your own insurance. However, the items that are not insured, such as a damaged bicycle, helmet, any lost earnings (all reasonably and directly attributable), can be pursued via this process.
The MIB website has the Untraced Drivers’ Agreement and a separate Guide that the OP may find useful to refer to.
