Xenon headlights - potential issue

As the nights have been drawing in, I think I may have an issue with my 2007 Clubman S xenon headlights.
A few cars have flashed me (I think) and looking at how the lights operate, I think I may have an issue. The beam from the drivers seat does seem a little high - although this could be my imagination and paranoia I seem to remember, when I first switch the lights on, they would adjust up and then downwards. Mine now do not move at all when I first switch the headlights on against the garage door.
If I do have a problem, it has affected both lights equally. If there is an issue what is the likely issue?

If it was just the one, then the motor would be likely (and they tend to point at the floor when that fails).
Could be a fuse or loose connector, and they're left in the last active position, but I can't find a wiring diagram online so would have to dig out a Haynes manual to check.
FWIW, I get flashed and mine are still adjusting OK.

You should still be able to adjust the alignment of the headlights. There will probably be adjusters on the backs of the headlights still.
If you are getting flashed then they are too high :-)
If they are not auto levelling as part of the start up procedure then, not speaking for Mini, but on VW's this indicated a levelling sensor was faulty. The lights would default (and stay) in their preset position.
