Motorway lane useage

Scenario:
Fairly empty motorway at night. Travelling along on a 4 lane motorway minding your own business at 80ish in lane 1 as obviously not overtaking anything. See some tail lights just infront of you, and the car is sitting in lane 3?
Do you go into lane 4 to overtake? Or, as they are obviously retarded, assume that they must have been in that lane for some time so shouldn't move over, as they in their minds have no reason to, meaning you undertake the lane 3 MLN?

Oh sorry I thought you meant the car was stopped or very nearly stopped in the 3rd lane, well to be honest it would depend on my mood, sometimes I would nip past in lane one on the basis that it is safe, and no body is around, if both of those criteria are met I may nip through in lane one, if however I feel something isn't quite right I'd pop over to lane 4 to pass then shoot back to lane 1.
This is covered in topics elsewhere - basically filtering past in lane one with a gap of a lane between you and the CLOD (Centre Lane Owner Driver) is never going to attract police attention nor is it against any written law. Ironically some of these 4 or more lane motorway stretches now have signs telling drivers to stay in lane.
The law on what is dangerous driving is based on the 'Reasonable man' Theory and should not need any further explaination to a reasonable person. It also needs corroboration by another independant and credible witness, video/camera in this modern age or a physical outcome, such as an accident. What all this means as that fortunately, a person who thinks, for example, that all overtaking is danagerous can never obtain a prosecution based on their one sided view of things.
Careless or inconsiderate driving also speaks for it's self.
Arguably a car sitting unnecessarily in the wrong lane is driving without consideration for other road users. Where as undertaking due to the presence of one of these menaces only becomes an offence if it is blatantly dangerous or you cause another driver to alter course or speed.
Overtaking/Undertaking is covered by the Highway Code and by and large what that says is best practice but A/D is also about safety. In the scenario where a car has sat needlessly in the wrong lane for mile after mile it could be considered safer to filter CAREFULLY past on the nearside than to pull across one or more lanes to overtake, especially in heavy traffic conditions. It is always going to be a judgement call and if you get it wrong a prosecution could follow.

Speaking as a retired police officer - the MLN or CLOD as they are known in the trade would always be the pull -- you in fact, would provide the evidence that were in the wrong lane. The shame these days is that policing roads is almost entirely left in the hands of faceless speed camera's rather than tackling bad driving practices. My favourite for getting a drink driver was a CLOD or front fog lamp user on a clear night both always provided good undisputable evidence or reason for stopping a driver. As the saying goes 'Drive like a p***t and you deserve to be caught' So why not - couple of quick "flashes" from way back and as approach be wary whilst passing in L1?
Not sure how I feel about people who overtake on the nearside by "accelerating" - but am more relaxed by those that cruise past at a steady speed. NOTE - I am a watcher in such circumstances.

Not quite the same thing, but last Friday morning I came across an old couple doing barely 40 in the right hand lane of th 2-lane section of the M4 between Swansea and Pont Abraham.
Suicidal or what? Luckily no-one was really tanking it so they weren't at risk of someone doing 100mph up their exhaust pipe.
I slowed down, checked carefully and overtook fairly slowly on the left, they got a flash as well. Looking in the rear view mirror, the following traffic did something similar but they continused on their way, oblivious...
